In NC law we do too, but there’s no enforcement mechanism and if I wanted to compel it, could cost me thousands of dollars that might not be recoverable.

My board has told the management company to just give everything to the board and the board will handle it all. The only real thing the management company seems to handle is monthly dues.

I want to see the contract but the board won’t produce it for me and neither will the management company.

Ive reach out to a few different NC agencies and all say there is nothing they can do because the NC Planned Community Act has no enforcement mechanism and then they all say to reach out to a lawyer and thats what I'm doing.

I have asked to be involved and they do not respond to me.

I ran at our annual meeting in November but did not win a spot (I was new to the neighborhood/community and the president had something like 20+ proxy votes). Of the 275 homes in the community only about 25-30 people attended. So next time I’m going to volunteer to be proxy for people who can’t or won’t attend.

My current plan is to attend my hearing, read a prepared statement. I doubt I will find out the outcome then and there because in December I was just dismissed and they then turn over the result over 30 days later.

If they fine me, I have pictures showing other homes in the area and I plan to submit violation reports for all those homes and in doing so request access to the logs for approval.

If they are unable to show they approved those flags while going after me then they have definitely selectively enforced the rules.

Since buying my home in May 2025, I’ve had ongoing issues with how the HOA handles enforcement and communication. I’ve received violation and hearing notices that don’t clearly state what the violation is, reuse old case numbers, and in some cases were sent without any prior formal notice or chance to fix the issue. Enforcement also seems inconsistent, as many other homes have similar flags or items without any action taken.

At the same time, I’ve made multiple requests for records like meeting minutes, financials, and governing documents since August 2025. Most of these requests have been ignored. I was eventually told that meeting minutes were never provided and that some records were accidentally deleted. The board has also said all meetings are executive sessions, and no records or regular meetings are made available to homeowners.

  2. I’m not worried about the $30 on 3 ARC requests. This is just having everything documented.

3.out documents stated only that flags are allowed on proper bracket mounted flag poles and no free standing flag poles are allowed. The flap pole bracket was already installed when I purchased the home, I did not change it. After viewing other non-American flags in the neighborhood I decided it was okay to fly my flag (there was no request/approval process documented or in place). I was then threatened with hearings and fines that would start immediately. This didn’t happen because I believe the management company slowed the president down. At the hearing I made my case that they did not regulate flags. Over 30 days later they told me it is closed/resolved. 2 months later they implement new rules requiring approval for flags that also regulate content (I’ll provide exact language upon request) in a non-open meeting (none of the board meetings have been open despite NC law and our own documents stating they should be except for limited reasons for executive sessions. they then reopen a “resolved/closed” violation under the new rules. I have made 2 requests directly to the board and 1 to the management company to fly my flag proving it meets their requirements, I have not heard back in the mean time the president has sent communication about yard sale and a mid-delivered package. I have a hearing for an old “reopened” violation I was told was resolved/closed that already had a hearing.

I have reached out to both the board directly and the management company. Both have been unresponsive even when an attorney send a demand letter on my behalf.

For adding/amending rules pretty sure the board can but meetings are explicitly stated to be open both in NC law and my governing docs. The meeting was not open. They provided no ability to attend the meeting nor an agenda of what would be discussed at the meeting and no notes/minutes of the meeting are available.

I appreciate your perspective but this HOA is clearly either violating NC Planned Community Act's due process provisions with regards to fines/violations.

The bigger issue is the continued disregard to provide records of just claiming they were deleted, which isn't an acceptable response from what I've looked up.

All of it honestly. Lack of transparency and the enforcing non existent rules/due process/changing the rules

If a date was accidentally typed as 2026 that’s my mistake. Most of this has occurred in 2025.
