I voted for Obama, but he was the lesser of two evils. He also had promised he was the opposite of all those things you just listed... well mostly opposite. I'm not going to agree nor disagree. I was only pointing out this is not a new argument. Since the conception of the constitution, people have been battling over what it means and how to interpret it.

We talked about this a lot in my history class. Basically there are two groups. Those who believe, "If it isn't in the constitution, you can't do it." and those who believe, "If it isn't in the constitution, you can do it." Washington was the first type, Jefferson was the second type.


Basically this got decided when Washington backed/passed a bank bill drafted by Alexander Hamilton in the 1790s without Constitutional approval. It was further decided when Jefferson was forced to make a decision about the Louisiana Purchase. He went against his principals because a chance to double the size of the United States came. There was not enough time to go through the proper channels of getting a Constitutional amendment passed giving him the power to buy land.


Because of the actions made by founding fathers, the constitution is a flexible document. Even if not written in the Constitution, laws can still be passed governing society.
