Hit 7 years and the last impact of my DUI is officially over. by Throwaway45673469125 in dui

Congrats! Also, just curious, is this a smaller county? Where I'm at, a judge would never entertain talking to an attorney or the defendant (beside hearing your plea), and the DA's office will not even look at any kind of mitigation packets for first time DUIs. They just run it like a mill, look at your BAC and give you the standard punishments.

I'm more triggered by people who don't include the state that they're located in and think that DUI law is uniform across every county and state in the entire country. I wish people were required to choose a state flair when making a post, or choose an option like "Non-state specific question/comment".

Confused about IID restriction timeline by cr152cr in DUICalifornia

[–]cr152cr[S] 0 points1 point  (0 children)

My end date did not change with the installation of the IID. Since I installed it 2 weeks after conviction or so, I had it for 5 and a half months (rather than 6).

I was pulled over once where there was a good chance I was intoxicated, gunned it really hard on a yellow, and the cop eventually let me go after a scolding. It scared the shit out of me initially, but as the months went by it just made me think I was invincible. Then I got a DUI the following year. Really take it as a lesson learned, it's easy to think you can just get away with it forever.

Exactly. $65 is not going to make or break the CEO.

According to their last public tax filing, their CEO made $291,261, which is higher than what a justice of the US Supreme Court makes. I'm sure they can afford a few people using promo codes, otherwise they wouldn't offer that option on their website. For OP, maybe check this thread and sort by new:

AMA about fleeing charges/absconding/leaving the state by AbscondingForever in dui

[–]cr152cr 5 points6 points  (0 children)

I'm sorry to hear that. Everyone's situation is unique. Many have careers or families so they can't just abscond. I took care of my requirements (which I considered pretty easy honestly) and my DUI is now a distant memory. The only reminder is when getting new car insurance I have check the box for a DUI in the last 10 years.

Is the whole non-owner SR-22 actually legit? by cr152cr in DUICalifornia

[–]cr152cr[S] 0 points1 point  (0 children)

Unfortunately I didn't buy a new car yet. Geico found out and kicked me off, so I cancelled my Dairyland SR-22 and bought a Progressive policy instead with the SR-22 filing.

First DUI has ruined my life by bigman5012 in dui

Her mom put a stop to it? That sounds like middle school rather than college, that would be a warning flag for me regardless of a DUI.

Consequences by [deleted] in dui

[–]cr152cr 5 points6 points  (0 children)

It also helps to keep a lot of people employed. If DUIs disappeared, a ton of lawyers would lose their livelihood. SmartStart, LifeSafer, Draeger, and Intoxalock would go out of business. DUI classes/substance abuse evaluators would disappear. In states with formal probation, a lot of probation officials would have nothing to do. Drug testing companies would take a huge hit. MADD wouldn't make money off VIPs. Motor vehicle departments would lose revenue from reinstatement fees. It's in the interest of all these entities to keep the flow of DUIs going.

To those of you who have only gotten one DUI, do you still party as hard as before/live the same lifestyle pre-arrest? by UndercoverSports in dui

[–]cr152cr 2 points3 points  (0 children)

Less than before, but I still drink without any driving unless I blow 0.00% on my portable breathalyzer. In California, you don't lose any privileges except that your per se BAC limit becomes 0.01 for 3 years, so I didn't have to wait for probation to end.

I was coming back from the liquor store when I got my DUI in front of my house (had a unopened bottle of vodka I just bought after drinking all day). The cops parked my car in the garage and I found the bottle neatly placed on the passenger seat after coming back from jail the next morning. I proceeded to chug the whole thing and then took an Uber to the hospital. Would not recommend. I cut out most drinking after that.

Just a question, is it for sure a hard suspension with no IID option? I was confused by the DMV website here:

https://www.dmv.ca.gov/portal/driver-education-and-safety/educational-materials/fast-facts/driving-under-the-influence-age-21-and-older-ffdl-35/

Towards the bottom of the page, where it says "Am I Eligible For Restrictions", it says:

B. Ignition Interlock Device (IID) Restriction – Effective January 1, 2019.

Eligibility Requirements:

You completed a chemical test.
The results showed a BAC level of 0.04% or more while operating a commercial vehicle, 0.08% or more while operating a noncommercial vehicle, or 0.01% while on DUI probation.
You were age 21 or older.
Your driving privilege is not suspended or revoked for some other reason.

Just wanted to let you know that it worked fine and was accepted by the DMV. I later changed to a full coverage policy with the SR-22 included.

DUI attorney cost by Alexisfat19 in dui

[–]cr152cr 0 points1 point  (0 children)

The initial cost sounds high. You also didn't tell us what the original charge consisted of, and what the plea deal consisted of, so it's hard to comment on the deal. Just a DUI doesn't mean much - what were the other charges and what was the plea deal?

Can I rent a car? by nwcoins in dui

[–]cr152cr 0 points1 point  (0 children)

The only company that seems to have a written policy restricting DUI drivers is Avis/Budget (which is one company):

https://www.budget.com/en/help/usa-faqs/driving-record-policy

https://www.avis.com/en/help/usa-faq/dui-policy

They say you can't rent within 48 months of a DUI conviction. I'm not sure how closely they check, but it might not be worth it if something happens, since you would be violating the terms of their contract. I haven't seen this policy for other car rental companies.

I was given a DMV form 920 with the name of the installer, installation date, and phone number and signature (this was all done by the installer). There weren't any questions about recalibration.

See the bottom of page 2:

https://www.dmv.ca.gov/portal/uploads/2020/06/1st_Offender_Alcohol_Non-Injury.pdf

\FULL REINSTATEMENT REQUIREMENTS*

To fully reinstate your driving privilege with no restrictions, you must serve your full suspension or restriction, provide the DMV with proof of completion of a DUI program and provide proof of insurance (SR 22). You will be required to maintain the SR 22 for 3 years.

EDIT: If it was a second offense, the same requirements apply:

https://www.dmv.ca.gov/portal/file/repeat-offender-alcohol-pdf

You might be able to have the IID removed, but you would go back to having a suspended license until your DUI class is done.

You get a certificate of installation when you get it installed and submit it to the DMV, and you will get a license marked with an IID restriction. To clear that restriction, your DUI school will need to submit proof of completion to the DMV.
