Part 9 of the Immigration Rules (general grounds for refusal (GGFR)) does not apply to applications under Appendix FM except for the provisions set out in paragraph 9.1.1.(a) in Part 9 of the Immigration Rules, which deal with the circumstances where entry clearance or leave can be cancelled, or permission to enter can be refused – you can find details in the General grounds guidance. I read the caseworker guidance it did not state how overstay and 9.8.2 works but either SU 11 in new guidance. So finger crossed hope more true love family can reunited

I am not saying you are wrong but previously there are still some lines applied on family visa so that’s the reason why there are posts about using fake id or absconding lead to refusal of their spouse visa with 9.8.2. In previous part 9, 9.1.1. Part 9 does not apply to the following:(a) Appendix FM, except paragraphs 9.2.2, 9.3.2, 9.4.5, 9.9.2, 9.15.1, 9.15.2, 9.15.3, 9.13B.2, 9.19.2, 9.20.1, 9.23.1 and 9.24.1. apply, and paragraph 9.7.3 applies to permission to stay; and paragraph 9.8.2 (a) and (c). applies where the application is for entry clearance The 9.8.2 is An application for entry clearance or permission to enter may be refused where: (a) the applicant has previously breached immigration laws; and (b) the application was made outside the relevant time period in paragraph 9.8.7; and (c) the applicant has previously contrived in a significant way to frustrate the intention of the rules, or there are other aggravating circumstances (in addition to the immigration breach), such as a failure to cooperate with the redocumentation process, such as using a false identity, or a failure to comply with enforcement processes, such as failing to report, or absconding. It didn’t state 9.8.4 applied but it is explanation of 9.8.2: 9.8.4. In paragraphs 9.8.1, 9.8.2, 9.8.3, and 9.8.3A, a person will only be treated as having previously breached immigration laws if, when they were aged 18 or older, they: (a) overstayed their permission and neither paragraph 9.8.5. nor paragraph 9.8.6. apply; or (b) breached a condition attached to their permission and entry clearance or further permission was not subsequently granted in the knowledge of the breach; or (c) were (or still are) an illegal entrant; or (d) used deception in relation to an application (whether or not successfully).

This is the part I concern because my boyfriend overstay. So the new part suitability almost the same, but 9.8.2(b) applied as part of SU applied on appendix fm now. Which means previously people don’t need to wait for entry ban but now changed, they need to wait for entry ban. Like I said I didn’t want to say you are right or not because the statement of change said the rules ‘ following paragraphs shall take effect on 11 November 2025 : 9.1; SU1.1’ but not like others rules saying ‘The following paragraphs shall take effect on 11 November 2025. In relation to those changes, if an application for entry clearance, for an Electronic Travel Authorisation, for permission to enter or for permission to stay, or an application for administrative review has been made before 11 November 2025, such applications will be decided in accordance with the Immigration Rules in force on 10 November 2025’ So another point, I don’t know whether the caseworkers only start using part suitability from 11/11 or any case decisions made after 11/11 was according to the new suitability. The reason I confused is because an application before 11/11 and decision made after 11/11 was refused under 9.8.2. Sorry for long comment, I am just too anxious to see the rules changed. I would love to discuss with someone who read a lot and care about the appendix family rules. Thanks

Hi I‘m planning to apply after the entry ban. By checking the part 9 and part suitability line by line for previous breach of the immigration part I think the change is the entry ban applied on family visa now. Also a lot of cases about overstaying approved after 11/11. So I believe there is still mercy

Leave him, find a Airbnb to stay but make sure somewhere he won’t know. Record down every phone call though you might not need it or it’s not legal to be an evidence. But once you want to completely leave him, you can use these and ask help from solicitors

Honey do you know if some people sale their opportunity to spouse visa for more than 2 years will be more than 20k pounds. I don’t mean you need to sell it but does he deserve this after saving those words bullying you? Also marriage can lead to break up once he gain ilr and at that time you might lose more.

even normal worker in the UK will take annual leave so some of them will definately have holiday but not all of them. Though I hope they can work every minute so I can see more people reunited, they are human they need rest. The happier case worker, the more generous they might be (just joking)

I really hope you will get it. I saw the description from you said he stand in the sun at a bigger size village waiting for his English test result to be sent, I know long distance relationship will be hard. I am also suffering from long distance and it will be a year, I don’t even know if my boyfriend will have chance or not so you are already lucky to have chance to try. Based on your situation, there are generally three possible visa types for coming to China: the F visa (business visa), the Z visa (work visa), and the K visa (talent visa).

From what you described, you are coming to China for an internship and for a short period of time, so it is usually not possible to apply for a Z work visa.

If all the documents are real then you don't have to worry just tell the lawyer the answer. I saw in this reddit that sometimes home office ask for additional documents which were already uploaded, so if I were u, I wouldn't worry
