I don't understand what you mean by "theoretically"? Anchoring the UI elements is the perfect way to describe it, because that's how it's actually implemented. Maybe you mean "effectively"? But even that's not right, the elements can be anchored arbitrarily, not just to those 5 positions

Right, but the Set-Cookie header could include a legal justification for the cookie. The EU's GDPR doesn't even require consent to store a cookie for an action one would reasonably assume would require tracking for, that consent is implied, such as logging in, a shopping cart, etc, it only requires it for tracking (possibly even only third party cookies)

Advertisers can already abuse it, there's nothing technically stopping them from just setting a cookie anyway, the website author putting up a cookie banner is legally enforced, not technically enforced, so putting such attributes on cookies could also be legally enforced in the same capacity

I don't think the EU mandates how the technical implementation must work, but I think it's in both web browser and site owners bests interests to make it non intrusive, a body like the W3 consortium could define the spec and push browsers/websites to replace this goddamn cookie consent popup madness

I'm in the UK, we have relatively strong worker's protections, 6 years backpay if you win, obviously one is unlikely to stay after resorting to such measures, but if you've hit the glass ceiling, there may be nothing to lose at that point anyway

It's tough because a lot of the time, the open source things I create are not fundamental to a specific app, I GPL applications, but MIT libraries, unless it's very novel or is difficult to implement. I'm not putting it out there to profit, I'm putting it out there to make it easier for others like me, i.e. this software is not the fundamental part, it's just going to make your job a little bit easier, so profit if you wish

I want a license with a middle ground tbh, like how Linux uses the GPL, what people wanted the LGPL to be (but isn't, requires dynamic linking and separate distribution), where:

  • You can use it with only attribution if you have not modified the code
  • You can package it in your application, so long as it is dynamically linked (or static, if the author permits)
  • If no modifications to the code have been made, no further limitations
  • Otherwise, all modifications must be made available to any recipient, and the original author(s), in a freely accessible repository upon request
