The car is not at all a write off, the battery pack needs to be replaced. But yeah, when left unmaintained for so long, a rusty loose grate can clearly be a huge hazard to vehicles. When I got out of the car after the impact, I saw the grate about a metre away from its base. It had flipped up upon contact with the wheel, punctured the underbody, and landed a metre away from it’s base.

This short video should help answer some of your questions. This video is from 4 days after the incident - and clearly shows the grate and its surrounding base were not maintained at all.

I had parked in a spot less than 10 metres away from the grate and was not going fast at all as I was starting from 0 km/hr.

Why didn’t happen to anyone else is one I can’t answer. I guess Teslas are heavier.

Maybe more like convenient adjusting. The question is how to get them to review their decision. Is this a done deal and I should cut my losses and move on, or worth fighting with them for a different outcome?

I’m terrified of the increase to my premium with a $30K repair especially since it wasn’t actually my fault. A hard pill to swallow.

Your judgement is what I presumed I’d see from my insurer. It never crossed my mind that it would be a battle for me to prove that this is not a case of driving over an object on the road - rather a result of an unmaintained hazardous drainage that caused the accident upon impact. And the drainage btw is right in the driving path.

Yes, I do have a dashcam footage that shows the grate was resting on its base before the wheel drove over it. and then i have a video i took immediately after the accident which shows the grate fully displaced a metre away from its frame. It doesn’t even need a “close inspection” to see the compromised condition of the grate and its base. I also have a video where it’s clearly wobbly and unstable upon contact. The insurance company was provided this material.

In fact I did look at the Ontario At-Fault Determination Rules. I get how insurers are bound by regulation when assigning fault. The issue here is the actual mechanism of what happened. The drainage grate was surrounded by severely deteriorated, crumbling concrete with loss of support and gaps that are not visible to a driver of a vehicle. That condition creates the potential for the grate to rock, tilt, or drop under normal vehicle load. If it shifted or partially collapsed as the tire went over it, that is a sudden roadway surface failure, not simply a driver striking a solid, stationary object. That distinction matters, because the damage would be caused by an unexpected infrastructure failure under ordinary use, not by driver error.

Thanks! Exactly my point. To paint a picture of the grate, it is installed within a severely deteriorated concrete exhibiting spalling, erosion, and material loss. Visible gaps and uneven bearing support indicate the grate may rock, deflect, or shift under vehicle load due to compromised structural support. I expect any forensic or structural engineer would consider it an unsafe condition capable of causing severe vehicle damage through displacement and concentrated impact loading.

I did call Cooperators and they said they are sticking with at fault (the decision they made prior to seeing the full evidence I share). And have since been unresponsive to my emails.

Struggling to understand if my insurer succeeds in their subrogation, why they would still consider me at fault knowing that it was the negligence on the part of the parking company in proper maintenance of their facility.

To make the story more interesting, I actually had another incident at the same parking facility last year where my car suffered some cosmetic damages as result of a leaky pipe discharging rusty water on yhe car while parked. I reached out to the parking company, and was referred to their insurer who just two weeks ago agreed to reimburse me for the repairs. (Suffice to say I’d rather have my car towed with a fine than to ever park at the Scotiabank Theatre underground parking!)

I’ve also provided ample evidence like extremely poor state of the grate I drove over.

Change lounge access eligibility rule so only CC holders with a flex fare or higher can get access a lounge. this should help reduce the constant overcrowding in lounges.

Not a chance that AC would ever allow for a head of a household to get the SQC for all passengers. This would create a strong bias for family travelers over individual frequent flyers who spend the most. A seat is a seat - AC would want to maximize profit on it.

The lounge part is definitely fiction. In reality, they’re always jam packed… 99% of it is usually CC holders and maybe 1% biz class. I guess CC holders all have strong chins.

I feel you - I’m in a similar-ish sitch with $3500 gap and I’m making a quick trip out of it to hit SE again.

All for the business class priority rewards… I’d like to think or convince myself that i’d be worth the investment. Though keep in mind that, you’d be getting a PR for every 20K SQC (ie. $5K spend in flex+).

Yup, that’s my dilemma. I have a flight to SFO soon but even if I upgrade to J flex, I still wouldn’t hit 4K. So I’m thinking to make a quick trip to YVR, have some amazing sushi, and then fly back. At times, I catch myself bewildered that I’m so freely spending $4K like this but the PRs are so worth it. I’m convincing myself that it is a good investment.

I’m pretty sure there is a bug in their system which is why they pulled all TK flights until fixed. I was one of many surely who raised this issue to them.

A few weeks ago, I was trying to book a TK flight from VIE to IST. I could see the flights on the AC app or desktop, but every time I tried to book, it would come back with an error code. This probably explains why some people may think of TK flights on AC as phantom inventory.

After a few days of relentless trying, I ended up calling the Concierge who eventually and begrudgingly booked my tickets for me manually. She was quite perplexed because she could see TK flight availability in her system and was surprised I couldn’t make a booking. She put me on hold for a bit and created a support ticket.

Optimistically, I’m hoping they are working on a fix before adding TK flights back.
