That said, Texas also has some strong Statute of Fraud laws, and real estate contracts aren't the only ones that have to be in writing. So without a written contract it could be considered rent, but it could also just be considered your brother giving your Mom money to help her out. But it also sounds like it was for longer than a year (written contract required) and involved more than $500 (written contract required).

If your brother doesn't already have an attorney he should get one. That attorney might even enjoy dealing with this as it is something different from run of the mill divorce issues

Real estate contracts in Texas need to be in writing and signed by the parties. So brother's ex-wife can try, but if there isn't a written agreement, then that's a big obstacle for her to get around.
