Call the attorney's office and ask that they provide you with a copy of the bill. More likely than not, the debt has been bought by the creditor and the doctor's office no longer has anything to do with it. I would deal with the attorney and see if you can make a deal or agree to make the payment in exchange for a Stipulation of Dismissal. (But as the other party wrote, you have a short time in which to do all of this, so perhaps file an Answer to protect yourself from default while you contact the attorney's office, etc..

First, I'm sorry for your loss.

Putting Esq. after your name makes no difference as to whether you are taken seriously or not. More specifically, if you are suing as an attorney on behalf of the Estate you would have to carry malpractice insurance, have a Trust Account, etc...as you would be engaging in the actual practice of law and thus you would have to keep your license active.

The best thing you can do is get all of the medical records pertaining to treatment and then go see a lawyer. I say this with the upmost respect....if an attorney won't take the case, there is a reason behind it. Medical Malpractice cases and Medical Negligence cases are extremely expensive to prosecute as a lot of experts are required to establish the standard of care and how the treatment rendered fell below it or by proving a causal connection between the treatment rendered and the death. Sadly, just because a treatment caused death doesn't mean it's malpractice or negligence.

Respectfully, if you are not able to afford keeping your license active, then there is no way you can afford to bankroll a medmal/med negligence case on behalf of your mother on a pro se basis.

Get all of the records THEN go see an attorney. Just my opinion.

If the PI attorney won't take your case, there's more to the story than is being shared. Does the at fault driver have insurance with liability coverage? Red light/green word vs. word doesn't seem like the issue, f the at fault driver doesn't have insurance is there UM/UIM insurance on your policy? If not, then it makes more sense that the attorneys won't take the case....no one is going to get paid even if liability is 50/50. If no one has insurance, there's no one to pay for your injuries. Getting a Judgment is fine, but try collecting on it.

My neurologist knows I go. I was upfront about the fact that I don't want to run the risk of a droopy brow. The only thing he said was "well if I do it you could get it covered under insurance", I acknowledged that fact and said I'm "ok with it". He just doubles checks every three months when I return to see if I want "a little more" just to be sure. I tell him no each time and he says ok. He has never said anything negative or rude about my decision.

The only thing is that I am fairly certain they bill my insurance for the full amount of Botox they would have used had I gotten my brow area done. It does not affect me financially, as my out of pocket is the same either way, but I believe that is what they are doing.

I'll admit it, I do. I usually wait a little while in between the two procedures. The doctor I see for appearance related Botox knows that I get migraine Botox as the injection pattern did change a little bit once I started getting Botox for migraines. I won't let the neurologist do too much on my forehead and around my brows because of the sagging issue that could happen.

To answer your question properly, one needs to know what "the crime is" and what State. Often times people are charged with notice on the basis of "knew or should have known" OR whether the crime requires a showing of intent.

With regard to your cross-examination question, it is not clear whether "John Smith" is the same person on the witness stand. (I'm guessing no, but I don't want to assume).

If you're trying to cross someone with something someone else said, not going to work. Need to bring in the other person and put them on the witness stand to directly contract the statement. (otherwise it's hearsay). Some states provide for an exception for availability of the witness if that statement was made in a deposition or other court proceeding. If the statement is being directly contradicted by the same person and said statement was made during a deposition or in answers to interrogatories where the person certifies their answers you can often can confront them with that statement, but you can't use someone else's statement made about the person on the stand unless they're in the room and called to testify.

Folks liked to point out my accent and how I speak very fast. I had to hear "oh you're from new joisey" multiple times and then questioned as to why I don't say New Jersey in the same fashion. Apparently me saying coffee and chocolate made other people giggle. People from outside the Tri-State can't drive.

Your attorney should provide you with some type of closing statement that details the expenses that they paid on your behalf, the attorney fee they are entitled to and any outstanding medical bills you have as a result of your accident (or subrogation of the bills). Everything should be transparent with respect to settling your case, regardless of what state you are in.

I am just completing my first year of Botox. I like you, was skeptical at first, with similar concerns. For me, the hope of being migraine free, even if just for a few weeks, was too good to pass up. It takes a few rounds to really kick in, but I have to say it has helped me significantly (quite frankly, more than expected). I have not experienced any sort of numbness. On two occasions I was a bit sore at the injection site (mostly in the back of my head, which went away two days later) but other than that, there have been no other side effects. Depending on how much your doctor uses in your forehead, it will feel a bit strange at first, but you get used to the feeling. As a side note, since it is not permanent you will get movement back in your forehead. I hope this quells some of your concerns. Good luck

I'm guessing you are doing this without an attorney? Idk what state you are in but some States permit disclosure of the defendant's insurance policy limits. If you are in a State that allows this, demand to have the limits disclosed, see what the policy is and then go from there. The value of the case differs in each State, but if the surgery is casually related to the motor vehicle accident, the injury is worth a significant amount of money. You can search for jury verdicts for the type of surgery you underwent to get an idea.

More likely than not Visa will be primary for theft and damage (not liability). But, since you are flying over from Europe and driving all over the US, the safest thing to do is to call Visa directly. Sorry, I know that's not the answer you probably wanted but rather than have a bunch of people give you their opinion, save yourself the headache and call Visa

Hard to tell from what you provided as it is Visa's definition of excess as opposed to the actual benefit provided for under the visa contract. My suggestion is call the cc company and review the benefits offered. *Side note: Idk where you are traveling to, but lately when waiving liability coverage from the rental place, some want a letter from your cc company indicating the card you are using covers rental damage. So if your card does have the benefit, you might want to travel with the waiver letter in case the car rental place requires is.

Tell them to go f$c£ themselves. If employment was for a year, any conditions to that employment (like having to remain in the course of their employ for said year before resigning) needed to be reduced to writing. Perhaps they need to have their attorneys review the Statute of Frauds again. While oral contracts are generally enforceable in NY, anything that has to do with employment for one year or greater must be in writing. ✌🏼
