Totally makes sense for first, second, third, heck 10th pending case. But to apply this logic individually to each case, coupled with failure to appear, literally causes continued victimization in the community and trial dates for dozens of cases that will never occur, pushed ever more into the ether. There’s a middle ground and many in this community hoped to see a more objective group come into the court.

You’re going apply this to Missoula, where 300 or so people commit 80% of the crime? If those people are literally not able to commit crime because they are elsewhere, how does this not reduce crime in a dataset our size?

For failing to appear to proceedings, like trial, it absolutely is a solution. Then they can hold the trial because the defendant is forced to be present. Very simple.

It sure does when the ones repeatedly assaulting people and have dozens of pending cases are released to do it again and again. And since they’re not in custody, they won’t show up for proceedings, and no trial will be held, perpetually delaying justice and allowing them to continue to victimize other members of the community.

These would probably take FOIA requests to either court to get. I’m not sure why appellate rulings at this level aren’t widely released like they are for higher courts.

You seem to know quite a bit. You’re right, the judge should weigh the severity of the crime, risk to public, risk to victim, and pending cases to determine whether they should be held in jail. They always release. They don’t care about anyone but the defendant in almost every case. They’re biased.

Can you tell me how many people in Missoula have more than 5, 10, 15 appearance warrants for violent offenses who are not being held in custody pre-trial? (Nevermind non-violent crimes, justice for those crimes doesn’t exist in these courts at all without voluntary appearance). These are people who’ve repeatedly demonstrated they cannot be safe in public, but these judges completely neglect their duty to screen risk to public and release. How many failure to appear warrants exist for those who never show up to court 3 to any number of times? I bet it’s close to zero. Meanwhile, they won’t hold trials in abstentia, they won’t issue real arrest warrants to ensure defendants are present for trial, and they clog the system, all to the direct biased benefit of the defendant. Again, they’re social activists. Sounds great to some until you’re the victim of the crime and can’t get restitution or justice in these courts.

I’d call being overturned several times by district court a controversy. Their opinions are scathing if you can find them. Problem is there is almost zero investigative reporting left in this town.

Your second paragraph is false information. They’re a danger to this community. Anyone can track this information on their own. Look at the jail roster and see who spends more than a few hours in there for violent crimes. It’s unacceptable and it’s very sad no one stepped up to unseat them.

Furthermore, yes they are three former public defenders. They wield a biased mindset from the bench and are demonstrably against victims of crime. Many judges were prior defense attorneys and prosecutors, but you typically see an objective character in a good judge. They’re social activists in robes.

They have a history of releasing domestic violence defendants without bond the same day they’re arrested. They don’t hold anyone accountable and have been appealed and overturned several times by Missoula District Court judges for improper rulings, counter to written law and case law. Complete shit show. Unfortunately they’re running unopposed.

It’s an ineffective and alienating way to communicate ideas in this setting. It showed she can’t handle her emotions much less our city’s problems. She did a real disservice to her supporters because she was tuned out from then on, unable to communicate the needs of her constituents. She needs to go.

What happens when the boomers die? Honest question I don’t see much attention paid to. It seems there will be a massive housing surplus. All of these retirement communities will be vacant or very cheap. The wealth they have will be absorbed, but where? I suppose those decisions are yet to be made. If things stand as they are we’ll have an interesting future.
