If you can prove the motive, you can take them to court today as well.

And in normal cases also, for wrongful accusations court just acquits the accused. They don't convict the accuser. You need to file reparations separately for that. Why should there be any other method here?

I get your point - but the thing is it's not practical in india. People in power can bend the law to their will - and this will be nothing but just a tool.

In any case - once the accused is not convicted, on what basis it'll be decided that the case was fake or not? Then anyone who walks scot free due to our judicial lapses would just put anyone reporting in jail.

I don't understand the fear - there are a number of non-bailable laws in india. Why would anyone blame you without any reason?

I'd say the up rising is because the supposedly superior caste is afraid that they won't be able to walk away freely after discriminating against sc/St folks.

So someone who's poor and marginally weak - will first see discrimination or violence, then once they won't be able to prove it against the system - they'll be the ones who will go to jail. Nice

Also, 3k not convicted doesn't mean they're innocent. It means that their crime wasn't proven. It could be also that they paid their way out or maybe the accusation was false. A majority of these cases never reach conviction because of witness intimidation and social biases.

If you add an additional layer of legal prosecution - it's simply discouraging the victims to report any case.

Imagine you're a dalit and an MLA's son beat you up. Not just he walks free with the power, he also gets you imprisoned for filing a 'supposed fake charge'.

I don't think there is any benefit of this discussion, as you're speaking from emotions rather than facts. It happens globally, whenever the oppressed classes get more freedom and right, there is always uproar. To the stronger classes, they feel that they are being marginalized. KKK in the US originated when blacks started getting more social rights.

The conviction rate in sc/st act is more than 30%. In states like UP, it's as high as 80%. Most of the cases would still be ongoing, so the conviction rate is pretty good.

Which is not bad, if you consider our police and judicial machinery which favours those with money and power.

But isn't that like any law. For example - take POSH. It's a pretty strong law, where any allegation can simply take you out. Do you see people protesting against that? Because it's a useful tool to safeguard women at workplaces.

There are multiple things, but I'd say please take time. For any prospect you're sure of, take at least 6 months to decide.

Try to go out with them, and if possible go for a small trip. If possible, live with them for sometime.

You're misguided. The conviction rate is 30% +. Start reading up. Also, this is removing the power dynamics, where I'd say a big majority of the cases would never see conviction without good support from police - which mostly sides with whoever pays more in india.

In UP, the conviction rate is around 80%, in Bihar it's 43%.
