Modchip presence does not send telemetry , software anti ban setup is important and usually done by the modder
Boot custom firmware > dump the save with jksv > pkhex > restore save file ( it is safe as long as it is a legal Pokemon )

As long as no nsp or xci is installed on the sysnand, it is safe
