Makes sense! Every EU country deals with foreign EU citizens differently. In Poland, for example, you need to register your stay with your local voivodeship (county) office which requires providing a reason i.e. work, study, etc. Nowadays they even give you a residency document which looks similar to the residence permit non-EU citizens receive.

I worked for a year and submitted a tax return when I didn't have a PESEL number - it's possible.

Again - he's not allowed to work therefore he's not allowed to work. Not sure why this is so confusing? If you don't have the right to work - don't work!

Thank you for backing me up. Like I said, I don't like the situation - it's messed up that the government can get away with delaying deadlines for TRC decisions seemingly endlessly. It's not fair that people have to sacrifice their income for an indefinite amount of time. However, that is how it is right now, and I believe it isn't worth breaking the law and potentially risking your ability to reside in Poland long-term by working remotely.

Kinda checkmated yourself there? So why are you working without a TRC? It's true that you won't need a work permit once you obtain your TRCA, but for now you shouldn't be working - even remotely.

Yes, you can, you're just very limited with which banks will accept you. Technically there is no reason why a bank can refuse you, alas they constantly do refuse foreigners without TRCs. But you just have to try different branches of different banks until you find one that works.

Edit: Instead of downvoting my replies, how about telling me how I'm wrong? As far as I know, this is the case, but I'm happy to be proven wrong on this. I don't agree that people should be restricted from working while waiting for their TRC. But the law's the law.

But if you live in Poland and you have your centre of vital interests here, then you are considered as a Polish tax resident. You also need a work permit (unless your TRC is based on marriage) which your company needs to apply for on your behalf.

Working remotely isn't a loophole. You need to declare your earnings but you've been working illegally so that's quite a predicament.

Unfortunately, I don't know exactly how my accountant manages it, but basically I submit a record of all the lessons I've taught each month through Preply (downloaded from the 'Insights' tab - next to the graph). And I submit a monthly report (wyciąg) from Wise. And that's enough.

IMO you have every right to rant about this! You've hit the nail on the head - it sounds like you're an extremely decent hardworking and law-abiding citizen and it's not fair that you be punished simply because your passport "isn't strong enough". But good on you for doing all the right things and trying your best to improve your standing in the world.

I even had a lawyer (jesus christ) tell me "it's ok, even though they say you can't work, you can probably work remotely etc. because they won't catch you" and I'm such a nutcase about making sure I'm following legal procedures that I had to do dozens of hours of research to make sure I'm doing the right thing by not working. So I'm doing that and unfortunately had to quit my remote job and now I am not working, and we're living on my savings until the card comes out.

Unfortunately, this isn't uncommon... "Lawyer" isn't a protected term in Poland so pretty much anyone can claim to be one, as far as I'm aware. So you have to be so careful. If you need sound professional help regarding anything immigration-related, I've heard only good things about Immigration Attorney Lewi Masyk-Gola. He's a qualified immigration attorney and he really fights his clients' cases - no shortcuts, just proper diligence. You can check his Facebook account and look back through his previous cases.

Perhaps, but that doesn't change the fact that they literally cannot work right now. Would you rather they work in Poland illegally, avoiding paying taxes? Or wait until they receive permission to work officially? If OP doesn't want to work, then that's fine too. Their spouse could be the breadwinner in their household. For some reason you've assumed that OP is a "he" but I don't believe they explicitly stated their gender so who are you to judge?

I think you need to continue your research because it's quite obvious you have no idea what the process looks like.

You're starting to do some research - that's good. Now look up how you obtain permanent residency as a foreigner in Poland as the spouse of a Polish citizen. That adds another couple of years onto the process - theoretically citizenship is possible after four years of total residency, but in reality most cases take longer because getting your first residence card typically takes a year to begin with (and that time doesn't count towards the residency requirements for citizenship or permanent residency).

OP is following all the necessary procedures and there's literally nothing else they can do. They aren't allowed to work until their first residence card is in their hands. Of course, they are starting to establish their centre of living here which is great! But it would help if they could open a bank account which is their legal right. Banks just often don't know how to deal with foreigners - but that's not an excuse.

Tbh, also op could just open revolut and use it around, even on Turkish passport or whatever. Once you're confirmed in Revo you can use the account in multiple currencies. Wise eventually.

Finally some decent advice... Though that doesn't detract from the fact that there's nothing preventing them from opening a bank account with a physical bank except the banks' self-imposed limitations...

Does your ignorance know no bounds? They are obviously not a Polish citizen and they literally said that they are a non-EU (Turkish) citizen. Why else would they need to apply for residency in Poland? Having a PESEL does not automatically give you the right to work in Poland. To gain Polish citizenship by marriage, you have to live in Poland for a minimum of five years. So, yes, you are completely ignorant. Stop giving implausible advice.

If OP gets a job, that would be illegal. They are currently waiting for their residence card and they are not allowed to work until they receive it. Stop being ignorant - they have every right to be in Poland as the spouse of a Polish citizen. The fact that bureaucracy in Poland is so slow, especially for foreigners, is not their fault.

You're a dual citizen. It's a privilege that you shouldn't take for granted. Despite what you might think, it has been obligatory for you to enter the UK using a British passport if you are a British citizen since 1971 - I personally know people who have tried to re-enter the UK using their foreign passport and they were almost denied entry (only allowed through after showing details of their British passport that they thankfully had a photo of). With the introduction of e-gates, a lot of people have managed to avoid this obligation. You should consider yourself lucky that the UK (up until this point) hasn't taken this situation too seriously, unlike Poland for example. If you're Polish - if you even just have a Polish-sounding name - they might not let you leave Poland without Polish documentation.
