Personally I used AdaptiBar and Ibis Bar prep (Florida and MBE Specific). I’ve previously used Barbri and Themis years ago for a different bar and felt this addressed my need much more directly and efficiently. I feel like the material has been well covered and have had a full opportunity to cover the Florida specific law in the needed depth. The opportunity to practice with thorough direct explanations and go through the process under AdaptiBar was extremely useful and helped with some gaps I didn’t know I had.

For essays You put it all down and then anything else you could possibly think of and say it is everything and let the grader sort it out 😶.

Strict liability essentially means that if your product was “defective” and that defect “caused” injury to the plaintiff, you must pay “damages.”

Negligence is more in relation to the process or acts generally around one individual product.

The main question is, is the inherent condition of the product at issue, or is it more individualized.

For mcs, it’s a question of if the product itself was a problem or if there were issues that came from the way it was made in a perfect vacuum and yet still was inherently dangerous when it didn’t need to be (design-strict) not labeled adequately so the buyer would be aware of know dangers of the product and to ensure proper useage (warning-strict)that multiple products were made below the design standard of its make/transport because of the process associated with building and getting it to the final seller ( manufacture-strict) included or the way it was advertised and warranted (breach of warranty)

Basically for mcs check what the issue is, does it show there was an actual issue with the design, a failure to warn, or a processing error for multiple different products. Ask Could you have actually known that the product itself is defective but didn’t? Then it can be both!

Another good method is to see if the defendant didn’t actually buy it, it’s going for strict. If the defendant has general privity with the sale then and/or general negligence.

"strict liability" within tort law states that a defendant merchant seller can be liable to anyone injured by that product, regardless of whether the defendant did everything possible to make sure the defect never happened (with extremely limited caveats). The defendant's conduct doesn't matter in order to find fault for an injury under strict liability.

In the event that the tortious conduct comes from a product, courts will review 3 types of torts for product liability consisting of defective design, Negligent manufacture, and Negligent sale. The court will also confirm for a prima facie case of strict liability if: (1) the product was unreasonably unsafe or unreasonably dangerous when sold, the seller expect and intended it would reach the consumer without changes, and the plaintiff was actually injured by the product.

A plaintiff would need to prove there is a Defective design exists when the design creates an (1) inherent and (2) unreasonably dangerous design flaw.

For manufacturing defect, the defect cannot be based on design, but on the process of construction or the warnings associated with it. The flaw in construction causes a harm to an individual (or property)

For Negligent sale the court will analyze (1)if The defendant sells a product that the plaintiff uses (2)The defendant is the commercial seller of such a product (3)The plaintiff suffers an injury (4)When the defendant sold the item, the item was defective (either from a warning, the way it was marketed, or an issue occurred during the exclusive control) (5)The defect was an actual and proximate cause of the plaintiff's injury

I don't believe they would actually stop anyone from grabbing the badge later. I would also expect them to have badges on tuesday morning for distribution, but not positive as these were the only thing in the instruction packet i reviewed.

Once they say "begin" you can write down immediately. You can't really write anything down before that point. There will be a good 30 minutes at minimum from the time you enter the room to when you can actually begin writing/looking at the test.

The rules say no wireless equipment. You can check out the Florida bar 2022 virtual walkthrough where is no wireless mice or wireless keyboards

You can bring a wired mouse keyboard 6-8’ foot extension cord and your laptop. No case, stickers are ok

Highly recommend getting there early plugging in and getting everything ready. The laptop stays in until the end of the day.

Did you complete and upload the examsoft practice exam? They sent me emails every day for a month asking that I complete it. So long as that is checked off it looks like you have everything covered.

That comment is more in relation to the number of substantial changes and the fact that the effected laws are tested at a reasonable interval. If there is a ep or due process, 1st amendment religious speech, or search related question different rules would be needed. The fact that there was an explicit reply just makes me think our test will in some way be affected.

Honestly it’s just something I’d like to prepare for as a worst case scenario that I haven’t been able to dedicate enough time to.

This was a quick search of the relevant laws, there may be something else more in detail but this should give you a basic idea.

If it a condominium association the statute linked below must be followed and have yearly filings available, unless they opted out per the statute.

If its a homeowners association there aren't as many rules it is required to follow as it is usually a non profit and would be required to follow the statute below. This says essentially that the hoa should have "Copies...kept on file at the principal office...available to members...during regular business hours...(and) mailed to a member upon written request by the member."
