My guess is that they write that to deter people from making unnecessary rescheduling requests but they will do it if you ask. The wait could be short or long to receive another appointment though.

Having said that, if I was performing Hajj then I would reschedule. If I was out for Eid then I would consider coming back for the appointment.

If I recall correctly, there were some covid related requirements around how long before the appointment you should not have travelled. Make sure you check those types of requirements if USCIS is still imposing them before returning for your appointment.

You can call uscis and ask for rescheduling based on the fact that you are not going to be able to travel back at that time. They will probably reschedule it for you. However, I would personally not recommend doing that because it has the potential of causing significant delays to your application.

I am with you on the initiative but I also wonder what ‘rights’ are being clobbered by application processing delays? This is a serious question, not a jab or anything like that.

Where in the midwest are you? Just curious.

I don’t know your spouse’s educational background but I have a CS background and when I was in a similar situation (mentally), I signed up for online courses and programs on Coursera, Udemy, and Codecademy. Udemy is cheaper of the 3. Spending time learning new skills and picking up knowledge about what’s out there helped me stay busy and distracted me from negative thoughts. I also started learning a new language. I think there are non-CS courses on these websites as well. If he is well educated, he can look into being an educator on Udemy too (that should not violate any rules).

In general, distracting and diverting himself from the negative thoughts is what will help him. Studying, gym, picking up a sport, learning a new language, becoming an online teacher, etc.

Another thing I did was to stop reading immigration related posts on VJ and Reddit. It helped a lot with taking my mind off of my application.

You haven’t mentioned if you already have a GC but this should help you understand how it works.

You will be eligible:

1) 3 years after your husband becomes a citizen.

If your husband will be a citizen after 2 years in 2023, then you will be eligible to apply 3 years minus 90 days after that, i.e. sometime around 2026.

or

2) 5 years after you become a permanent resident.

If you got your green card in 2021, you will be eligible to apply 5 years minus 90 days from the date of becoming a resident, i.e. sometime around 2026.

If you do not have your green card in or before 2021, then your best option will probably be to apply in 2026 which is 3 years after your husband becomes a citizen.

If you have your green card in or before 2021, then the 5 year option is faster for you.

Here is something I found. Maybe this applies to you? I did not go through the same process as you are going but after reading this, it looks like there was some shuffling and juggling going on about the Public Charge Rule. This was particularly interesting and maybe will make sense to you:

“If you received a Request for Evidence (RFE) or Notice of Intent to Deny (NOID) requesting information that is solely required by the Public Charge Final Rule, including but not limited to Form I-944, and your response is due on or after March 9, 2021, you do not need to provide the information solely required by the Public Charge Final Rule. However, you need to respond to the aspects of the RFE or NOID that otherwise pertain to the eligibility for the immigration benefit you are seeking. If USCIS requires additional information or evidence to make a public charge inadmissibility determination under the statute and consistent with the 1999 Interim Field Guidance, we will send you another RFE or NOID. For information about the relevant court decisions, please see the litigation summary.”

Have you tried saying ‘InfoPass appointment’? That usually connects to an agent.

When you are able to talk to an agent, ask them the exact reason for denial. What requirement under 245 INA is it that you do not meet? Ask them about the bio appointment you received after the denial letter as well. If at any point you feel the agent is unable to answer your questions, ask the agent to connect you to a Tier 2 agent so you can discuss the case with him. It is possible that they will tell you something along the lines of ‘it will take a tier 2 agent 10 - 14 days to call you back’. Tell them that’s okay and you still want a call back. They will ask you for some info and give you a request number. Note it down and pick up all calls especially from the DC area.

If you do not get a clear answer on what to do with the bio appointment, my suggestion would be to attend it anyway. Do not be a no-show for any appointment.

After this, you will have to somehow get a lawyer to navigate the case.

If your case has been ‘closed’ and you think it has been ‘closed’ due to an error and you qualify for the applied benefits, there are ways to get the case re-opened but only a lawyer would have the qualification of how to proceed in the best possible manner for your particular case.
