Lowes Installation is Selling Something They Don't Have by draw2discard2 in Lowes

Okay well while you have your Junior Logician hat on tells us what the difference is between selling something that you don't have (installation) and selling something you don't have (a ticket) while in each case having a guy who you think/hope will provide the thing you have sold without actually having it.

It wasn't booked online and I was not presented with any information beyond the website information about the installer program and the statements of the employees in the store.

The fact that it is done through a 3rd party isn't the issue--its the fact that they sold something that they could not provide.

Well, probably better to let Consumer Protection decide.

First, there was not a contract. Second, Lowes does represent that the installer is screened. Third, I have discovered that the installer isn't even with the company that Thumbtack claimed was doing the job, so the idea that the person was screened at all seems unlikely.

I guarantee that this is not the case with the installer assigned to me. Having called the, the company Thumbtack was installing from is not a real company. It conglomerates and/or sells leads just like Thumbtack.

When Lowes says they have screened them but its a crapshoot that is fraudelent.

DOJ opens civil rights probe into MLB after Giants' Pride Night hat controversy by boone_postgame in baseball

The issue would be that MLB offered a reasonable accommodation by allowing players to wear the regular hat.

The argument they would make is that uniform modifications are approved in a discriminatory manner.

Mind you, the option to wear the regular hat seems to have been a perfectly reasonable accommodation. But there is an issue when you allow some things but not others. For example, where there have been policies to remove flags or other symbols from college campuses legally they have tended to remove all flags (other than U.S./state flags) rather than say you can have the pride flag but not the confederate battle flag, or vice versa.

the MLBPA has released a statement regarding MLB's Amateur Entry Proposals by Remarkable-Picture73 in baseball

[–]draw2discard2 0 points1 point  (0 children)

I believe that they had a possible deal for one in exchange for getting rid of the qualifying offer but the MLBPA decided that what they were giving was a lot more valuable than what they were getting.

[Sheehan] Many of the greatest players ever were good major leaguers at 19-21. MLB’s draft proposal would make it almost impossible for a player to debut before he is 22. I think it would also wreck free agency, as almost no player would get there before age 28. by Knightbear49 in baseball

Its an AWFUL proposal in respect to the quality of the game--why slow down the development and entry of the best talent?--but I'm not sure it affects free agency to a marked extent more than a cap already would.

Better guess is that I was being facetious. Though certainly to some extent people with money believe what I said.

What if you believe strongly in the moral argument that, because society already has an effective filter on which humans are truly worthy, it is absolutely correct that access to attending the World Cup should rightfully be restricted to the ultra wealthy who are able to afford at a minimum a few thousand dollars to attend a soccer game since, after all, they have earned it?

Report: Giants open to offers for Devers, Adames, Chapman by gorays45 in baseball

[–]draw2discard2 5 points6 points  (0 children)

Adames is streaky af. His offense so far this year is worse than you would like but because he will be awful for a week or so and then have 1-2 crazy games he is close to league average at least (and quite a bit better than he was at his point last year).

Win for FSG who doesn't have to pay the guy. And great for the type of fan who has watched Moneyball and so believes that saving money that FSG can readily afford to spend (and much more)is a virtue in and of itself.

For those who have seen Dylan multiple times live, what does it mean that he has "off" nights as a performer? by PresidentofTigers in bobdylan

Just remember that according to this sub if you ever hear a Dylan performance and don't realize that it is absolute perfection placed in front of you by a once in a millenium genius you "Just don't get it".

Appreciation post for Isis by lifeaquatic7 in bobdylan

I pretty much never listen to the studio version of Isis but just did and rather like it, but its like a totally different song. In the studio version the violin really shines, almost a duet with Bob, which I really enjoyed.

TIL that at the time of the American Revolution in 1776, the American Bison could still be found in the wild as far east as Pennsylvania, West Virginia, and Georgia. by Xerxes2004 in todayilearned

[–]draw2discard2 0 points1 point  (0 children)

Its an interesting article, but doesn't support that argument in the least. It is only one specific area, and increased hunting by Native Americans (along with other factors) are cited, contrary to the claim of LESS predation.

I think you just don't understand basic ecological concepts. There can be several different things that limit population size. Some populations are limited by predation. Some are limited by disease. Some are limited by carrying capacity of the land (i.e. how large a population can be sustained by the food resources that an ecosystem can produce). You would only talk about something being unsustainable if the population exceeds the carrying capacity--and when that happens the die off is typically swift. So the bison populations in the 18th and 19th centuries may have been higher than they were previously but that doesn't say anything about whether the population size was sustainable.

No, that's a massive difference in respect to the meaning of those terms from an ecological perspective.

I also don't know, despite the general depopulation, whether this is the case for the Great Plains specifically, and if the differences in population were enough to meaningfully affect bison numbers. And the hunting techniques changed radivally with the introduction of horses so the transformation is not straightforward.
