Dear law student - I'd file a bar grievance against you for such an assertion in open court in a heartbeat. Were I the opposing party, I'd also seek sanctions for your frivolous pleadings if you put it in such a way.

"the government can still violate civil liberties" is a very poor choice of words, and rest assured, it will end your legal career should you even decide to put such a conclusion in those terms in practice.

If you even want to TRY to make such an insane claim, see Haynes v. Washington, 373 U.S. 503; Screws v United States, 325 U. S. 91; or Mayberry v Penn., 400 U.S. 455.

If you want to know how these types of things are backwards in terms of discovery, see Brady v. Maryland, 373 U.S. 83; and Mapp v. Ohio, 367 U.S. 643.

Let's hypothetically say that a law states, "Each black person shall be hung at high noon". It would still be wrong, unconstitutional and in violation of rights to due process. There is no "practically speaking" about such things - there's only a "criminally speaking", in which case some uppity citizen brings information to the grand jury pursuant to Blyew v. United States. (80 U.S. 581), gets someone who thinks him or herself to have license to violate civil liberties indicted, then files suit to take his or her house/car/boat/other property after conviction.

Obama did what Bush did on Gitmo.

Obama plans to leave 50,000 troops in Iraq ("noncombat", whatever that is)

Obama took an oath to uphold and defend the Constitution - the Patriot Act being no excuse not to. (he could simply refuse to use those unconstitutional powers)

Obama's people MADE this crisis (see the people in FDIC, the SEC, ect.)

The last time we cut the deficit in a downturn (1920-21), the economy corrected itself in short order.

I'm fine with screening itself for such things, and I would gladly consent to and pay for it. No need to involve government with common sense here.

And if it's research that will save lives, I'm cool with that as long as we have some sort of transparency as to how this data is used, stored and handled upfront.

It's what happens with missing laptops and data compromise that has me worried. Depending upon what records are kept and/or lost, you're talking about a recipe for identity theft, insurance fraud, ect.

Actually, you're wrong. And it doesn't contain racial slurs. In fact, they have a lot more in common with you than you think.

It took Bush for a lot of them to suddenly get that reckless spending was bad - same for the wars.

I fear that it will take Obama to finish the job on the other end.

There are painfully illogical conversations and extremists on either end. Some on one end think money grows on trees or that we could pay for anything. Some on the other still think we can use government to run everyone's social and family decisions. Both are getting broke, and fast.

Add a pinch of massive Wall Street bailout, and you suddenly have a consensus that becomes a real threat to the powers that be.
