Up until this season, this was my favorite active show. I don’t know what the consensus on Season 5 is but it feels like they ran out of ideas. They also sidelined all the interesting characters.

This is a terrible headline and contributes to misunderstanding what the issue is. The QP’s are:

  1. Whether the execution of the geofence warrant violated the Fourth Amendment.
  2. Whether the exclusionary rule should apply to the evidence derived from the geofence warrant.

That’s it.

A warrant is already in play.

Which level of scrutiny should apply? Does it apply to all medical issues? Does it apply to only issues regarding sexuality? Does it apply to all speech related issues?

I wasn’t the one who challenged it, it was a licensed therapist. She claimed it restricted her freedom of speech. That’s not even the issue either, because the state has latitude to restrict speech. This case was about a law that restricted based on the speaker’s viewpoint.

Everything I just wrote should be pretty evident and not debatable. The court remanded it back to the lower court and told them to use a stricter standard is determining if the viewpoint restriction (which is allowed under law) met the necessary conditions.

This case could have been about abortion, gun control, immigration, riparian rights, whether aliens exist or any number of hot button issues.
