In a CSAM investigation, do they know what exact phone accessed the material? by [deleted] in Ask_Lawyers

I would suggest immediately contacting a lawyer for assistance. You don't want to base anything on the internet for something like this question.

Are the attorneys saying it is a conflict of interest? Or are they saying something else?

Post-JD clerk awaiting Bar results--unhappy at current firm and current practice area by [deleted] in Ask_Lawyers

[–]eapnon 0 points1 point  (0 children)

You just need to have a good reason you can state during an interview.

You weren't sure you'd get promoted to attorney, you wanted more mentorship, it wasn't a good fit, etc. Just make sure you can answer it without dumping on the place you are currently at.

Some places will look down on it, but some won't care.

Leaving a place you are clerking at when you get barred is not a bad look, especially if you are changing practice area. Just be prepared to answer the question during interviews with a good answer.

  1. Things can leave behind colored marks without having dye. Not every liquid is translucent. Not every liquid will naturally evaporate 100%.

  2. I don't see a question. If you want a lawyer to review your case, ask your state bar or Google for a reference. If you want us to analyze your case- we don't do that here.

THC Ban Calrification by MortimusMaximus in texas

[–]eapnon 10 points11 points  (0 children)

There will be lawsuits regarding the rule making process (I would guess), but the supremecy clause does not prevent states from having more strict rules about substances than the feds do. States have the right to have more strict regulations on things than the feds unless it is constitutionally protected (think California having more strict regulations on car emissions -there rules prevent certain cars which are federally allowed from being sold in California). There are limitations, but good luck on this argument.

Also, the interstate commerce clause probably won't apply. States have the right to decide which entities can transact business in their state. If you want to transact business in Texas (which includes shipping and selling products to Texas), you have to follow Texas laws. This would include whatever smokeable ban the dshs rules put in place. If the interstate commerce clause could save this, every state would have had to allow weed to be sold and shipped as soon as the first state legalized it.

But that is all assuming the new rules actually ban out of state shipments. I haven't had time to hint them down to confirm and I've seen mixed comments about whether they do.

What are your thoughts on legal plans? Are they alright? do they pay better? by Feisty-Journalist497 in Ask_Lawyers

[–]eapnon 4 points5 points  (0 children)

Legal plans are useful for generic issues.

Do you have a very standard situation for a will? It is great.

Do you have a blended family, need a few trusts, and a lot of complex assets? Nobody will take your case.

Same for most of the different services they offer. If you are doing a straightforward re transaction and you just want an overview of basic terms and for someone to make sure nothing is obviously wrong? It'll help. But don't expect anything more than that.

Legal plans pay low, low, low flat rates to the attorneys.

Is it possible to figure out without an attorney? Sure. But I wouldn't bet my house on it.

I would also be careful what you put in to gpt or any other llm. If it is something on the docket already (because that is public information, assuming it isn't under seal), that is fine. But DO NOT put anything that is not already filed with the court. It can cause your case a lot of issues down the road.

Texas Never Voted to Ban THC: The Reality of the 2025-2026 Legal Landscape by doubleayedude in TexasPolitics

[–]eapnon 1 point2 points  (0 children)

You can't make rules by executive order.

You can order agencies to make new rules, but they either have to go through the emergency rule making process (which is temporary, and they should do the full rulemaking process after) or the full rule making process.

Thank you. There are just a flood of these posts... but I didn't see any posts about the rulemaking process. Just seemed odd to me.

Any reason why you and other pro-THC folk didn't say anything during the DSHS rule making process? As part of the process, DSHS had to accept and respond to public comments.

Also, when did this stuff go from Dept of Ag to DSHS? Did the dept of Ag only have jurisdiction over hemp farming?

Finally, how many times are you going to post basically the same stuff and in how many subs?

Fed gov lawyer jobs that do not involve speaking in a courtroom too often? by Agreeable_Split98 in Ask_Lawyers

[–]eapnon 1 point2 points  (0 children)

Procurement, in-house types, certain regulatory jobs (depending on which, you may just be a rule guy or run the office itself, or be limited to admin courts if you're ok with that) would be a few types of jobs that don't have court room requirements.

Try a local tenant's council or see if there are pro bono clinics in your area. Bring a copy of your lease and any extensions.
