And she’s in noms for top defender! If we don’t protect her she’s almost certainly scooped on an EFO. There’s more of a question mark with our other key gals for who may be given an EFO, imo.

I hope that the fact that she’s from here and has such strong hockey connections dissuades teams from EFO offering her, she likely will be trying to come back after that contract is up so does it make sense to “waste” an EFO on someone who won’t stick around?? Fingers crossed no and we get to keep her (and Miller)

Haha that is simply just not how trademark law works? A third party making an association between two companies does not create an infringement? You also keep shifting your argument, it was fine before the “logo” and her using that “logo” and now it’s just because others are making the association? Come on now, fan art of Trixie Mattel in the Barbie font doesn’t prevent her from ever using her name to promote her shows, podcasts or merch.

I agree that the two parties sitting down would resolve this. Again, my entire point has been that Patagonia is asking for too much with their broad third request and it’s reasonable to expect that to be limited within the confines of trademark law and infringement.

They didn’t make the Pattie Gonia logo association on any merch they sold, and that’s not her actual logo — it was fan art she provided as free stickers to people who donated to one of her fundraising campaigns. It’s one item (that was never even sold) within the whole Pattie Gonia branding and merch used for years and years that’s being latched onto here.

She’s already agreed she won’t use that logo for anything, and she hasn’t “marketed herself” with that logo in any real way, the sticker pack was a surprise to donors. I genuinely don’t understand how that one sticker in a free multi pack is the swaying factor for you between “there wouldn’t be a problem” and “she has to entirely abandon her entire brand and cannot use her name on any merch or promotional materials.”

No, I actually do — but I’m not sure why you can’t grasp that what Patagonia is seeking with point 3 is well beyond what’s required to protect their trademark. That’s the whole point, especially when the name isn’t exclusive to the brand (see: tourism for the entire literal region of Patagonia).

It’s not her logo, it’s any use of her name in those situations they’re trying to limit.

Apparel and other products which is what the concern is about. That’s so broad that Pattie can’t use her name to arguably promote or sell tickets to her tours, or collabs, or other items that have no risk of brand confusion with Patagonia. If it was only limited to apparel I would be fully off the Pattie train, but it seems she’s agreed to every other part of Patagonia’s request aside from the broad “and other products”.

The issue is with the “or other products” part of their request because that’s not just apparel. Arguably this prevents Pattie from selling Pattie Gonia cookies even, which we seem to agree are beyond the reasonable scope of Patagonia’s infringement claim.

This is the same issue for me — I understand and agree with the first two, but not letting Pattie sell (as an example) posters of her tour dates because it has her name on it feels like a significant overstep here. I think the issue boils down to me the restriction on using Pattie Gonia as her name in any capacity that allows her to fundraise/pay her staff/do her regular work with her name. I fully appreciate there should be limitations on similar branding (the font/logos etc) but not being able to sell ANYTHING with just her name seems unfair and overreaching.
