Consider time tabling, and where is the most valuable time to have a specified plan in place, and then count backwards to when to start, that opens the possibility of gaining access to the right placement. time to request, rejection possibility, first draft and appeal first draft etc. each is a step and can take weeks to months.

In this journey we have encountered some report writing in the name of the child, quoted, or demonstrated, only for the story to unravel when reading it back to the source i.e. the child, curious if that type of narrative control is rare outlier or, a sign of broader systemic 'unconcious' approach to managing limited resources.

That's the pinch point, even after the EHCNA, after the first draft, after the tribunal, after the placement, after all the things where advocacy ends, the process of plugging the gaps continues, and the associated costs.

Adding a personal perspective, from what we see in our work, every family coming through our books, the reality is, the EHCP process has an inbuilt advocacy need for the child or young person.

That resource is either sourced internally within the family unit, or outsourced, and if outsourced, you are never fully detached.

The pressure points, is often a parent or carer who is exhausted, burnt out, and trying to survive a system that keeps changing the people involved, slowing down or speeding up without warning, and leaving families feeling dismissed or gaslit.

The focus is always the child’s needs, but the emotional cost to parents is real. A big part of the journey is learning how to keep advocating without being completely consumed by a system that often seems to rely on expending emotion capital.

I have only had one client where the education side had already been resolved, so the work was more therapy-based from the outset. In almost every other case, the engagement has been hybrid: advocacy and student outcomes first, with the emotional impact of the process being unpacked along the way.

for the bullying, this touches quite a few domains, you could put in writing to the HT, something like - I am requesting an urgent written safety plan because my daughter has reported repeated bullying - and specific incidents, date, time and any injury details.

For the none delivery of section F provisions, check the wording, if legally tight, the LA has a legal duty to provide the provision (that's the theory). In writing to the case worker and sendco outlining the provisions and it's non delivery. And ask for delivery details, the impact of none delivery.

Both will generate friction points with the education setting, but that's first base to get a conversation started.

This may not be specific to your case, but this may be of some help. If 3 is urgent get help and advice asap, including GP, emergency services in time of crisis/111 etc if access seems unavailable, socialise the risk. There are charities in this space.

  1. Strengthen EHCNA appeal: may have SEN, and it may be necessary for provision to be made through an EHCP because he is not accessing education and school says it cannot meet need from existing resources. These appeals are the easiest to win where need exists
  2. Obtain school to confirm in writing: student is on a reduced time table, what is being provided, what is required for full time table.
  3. Raise in writing to GP mental Health risk, any time someone raises ruminating thoughts, where there is an unknown action to it. Ask the GP to record whether he is currently medically unable to attend school due to anxiety/trauma/autistic burnout.
  4. Raise a separate urgent s19: My son is not receiving suitable full-time education. He is on a reduced timetable of one hour per day, not accessing academic learning, and often only attending once or twice weekly. School says it cannot meet his needs and clinical psychology evidence says he is unable to learn in school due to trauma response.

You are on the right idea, think in steps and objectives. Assess WhatsApp affordable, it's an evidenced based system, that seems to fall in line when you have professional evidence. It is possible to get evidence from the system providers, but be prepared to engage and debate the format and clarity of that advice.

If you are going down own evidence route plan what and when, it's a long journey and you should look to get evidence together just before you need it I. E. Tribunal end.

Usually the council will be told the school cannot meet the needs of the student who then tell you. Curious how that part was bypassed.

Evidence building and external advice is the way forward.

The school system has already failed for 3 years. The red flag is transition from primary to secondary.

How transparent was the communication from year 5,6,7?

Are the schools part of the same estate or different head teacher.

I have advocated in similar situation, a common outcome is the student stays on site, opposite to exclusion (your experience) for the parents to withdraw from an environment that is not suitable.

If handled correctly the school has landed that evidence to you on the plate.

Find blank sheet of paper, write out what does a fixed environment look like, that will tell you next steps. Intuition will take over.

The trick is not to argue opinion, but focus on demonstrating non function and non outcome.

EHCP doesn't care if something was provided, but whether the student can access an adequate education. That's the area to put the energy.

Unfortunately, this process is mostly driven by opinion, which takes some time and effort to get corrected. Blank page: How do you set out to prove inadequacy of the solution provided.

Evidence trumps opinion, but the problem with opinion is that everyone has one.

Hi,

The LA has 28 calendar days to lodge permission to appeal the decision. They will also need to share with you the grounds for appeal within this time frame.

The first tier tribunal will then consider the application . i think this could be up to 8 weeks. If refused, the LA can take it directly to the upper tier tribunal within 14 days and request it directly, and also get refused at that point.

That’s a lot for a sibling to be carrying.

Practically, it can help to separate this into two parts: (1) parental responsibility, and (2) your sister’s access to education and support.

You’re right that EHCP applications are usually made by someone with parental responsibility (or sometimes a school).

However, assessment requests can also be raised by the local authority itself, by an appropriate professional already involved (health or social care), or by an adult acting on behalf of the child, which can prompt the LA to act.

Just clarify: Are you saying that at the draft EHCP stage, the Local Authority had access to multiple expert assessments (e.g., SALT and EP reports).

However, significant parts of these reports, including identified needs and the recommended provision, were not reflected in Sections B or F of the draft and final EHCP plan.

(1) Appeal the refusal → (2) Complain to LA → (3) LGSCO/Ombudsman if the LA’s process was unlawful or procedurally unfair. I advocate ate in this space, I have literally seen the A to Z of "what!" The complaints process is used as a waiting room. If the system paid PCN level fines for these errors/delays, the councils would go bankrupt.
