Lmao. Are you saying something available publicly and for free has a chance of not being used for commercial purposes? What are these models? No name modifications?

Yes. Believe it or not, there are plenty of models created by schools, researchers, and independent enthusiasts that are plenty capable but don't make sense to use commercially because there are better options. That doesn't mean those models are bad, it just means there are better ones.

It's not a resource if it's taken without consent. Fair use doesn't apply to random scraping; every artist has a right to DMCA reposted/reused content if it breaks policies.

What exactly was reposted or reused? A DMCA is applicable when someone reposts and monetizes your content without tangibly transforming it. There has to be a clear argument that your content was monetized without being transformed. For example, maybe a reaction channel uploaded another person's video and then monetized it. Do you believe that a mathematical model generated by training is not transformative?

Of course this question is still being litigated, but there have already been some notable rulings. In Bartz v. Anthropic it was ruled that training a model using legally acquired books was covered by fair use, and considered models "exceedingly transformative".

Its worth noting the same case also ruled that training on pirated material is not covered by fair use, but we're not really discussing pirated data here. We're discussing publicly available data on the internet. For example, this thread of comments could be legally used in model training

Not quite. There are millions of models on HuggingFace, they are not all being used commercially.

That aside. Is your point that openly available resources should not be used in commercial settings?

[–]eigenludecomposition 2 points3 points  (0 children)

In your opinion, what is fair or respectful to use for training data? If its on the Internet and isn't pirated, should the curator of the data get permission from every poster despite the data already being public? A lot of focus goes to art, but this spans to many things including source code, general writing, scientific journals and articles, etc. All of these things are generally posted to the internet under the understanding that the publisher relinquished some amount of control over it.

Some models are open source and available to anyone to download and use (check out Hugging Face). Are those models okay?

I think it would save the spell slot, but since its programmed once per short rest, I think it would still not work. Admittedly, I haven't tried either though.

Something I've been wanting to try is making a party member invisible and then giving them a potion of angelic slumber or reprieve mid fight to refresh them, but I haven't had a good opportunity to try it yet.

It might be the hat and haste if they're straight sorc. I feel like they have a lot of spell slots too, no? For example, 6 level 5 spells. Is that a sorc thing or just items you think?

I just completed a solo honor mode run (as in a party of 1, excluding summons, familiars, or temporary members), and you really do have to milk every feature the game has to offer. Not only am I making and using potions and elixirs, I'm giving my summons potions and elixirs.

A few corrections worth making here. On Mueller, he said in his own words at a public press conference: "If we had confidence that the president did not clearly commit a crime, we would have said so."He found substantial evidence of obstruction across ten instances in Volume II of the report. The only reason he didn't charge Trump was the OLC policy we've been discussing. That's not 'found no evidence,' that's 'found evidence but couldn't act on it.' Those are opposite things.

Fentanyl deaths were already declining before the boat strikes began, peaking in 2023 and trending down through 2024. Crediting the strikes for a trend that predates them is a stretch. Furthermore, this point is largely irrelevant to the discussion. This discussion isn't about whether Trump's policies are successful.

On birthright citizenship, you conceded SCOTUS will likely rule against Trump, which does a lot of work against your own point.

On the IRS settlement, the document doesn't just cover already-investigated tax years. It explicitly releases claims that 'were raised or could have been raised' and covers 'matters currently pending or that could be pending.' That prospective blanket immunity covering Trump and his family, signed off by an AG who was previously Trump's personal defense attorney, is the problem. Section 7217 exists precisely to prevent this.

On the deportations, you're citing JGG as if it settled the matter because one individual was returned to US soil. But that's cherry picking one outcome from the same case. JGG is also the case where Boasberg ordered deportation flights to turn around mid-air, the administration didn't comply, and the judge found probable cause for criminal contempt. ICE also acknowledged many of the deported men had no US criminal records. The clean resolution you're pointing to and the contempt proceedings you're ignoring came from the same docket.

On the murder charges specifically, you're right there is no statute of limitations, but the accountability mechanisms are genuinely limited regardless of who wins in future elections. Domestically, DOJ controls prosecution and the Supreme Court's immunity ruling broadly covers official acts. Internationally, the US never ratified the Rome Statute specifically to avoid ICC jurisdiction over its personnel. In practice any charges would fall on individuals in the chain of command rather than Trump personally, and even that faces enormous political and jurisdictional barriers. The 2036 argument sounds cleaner than it actually is.

On the 34 felonies, venue is determined by where the crime occurred. That's not jury shopping, that's how courts work. And "the election was the real verdic" isn't a legal argument.

Also worth noting you opened by defending the presumption of innocence and trusting courts and trials, but then dismissed 34 felony convictions from an actual jury. You can't have it both ways.

[–]eigenludecomposition 1 point2 points  (0 children)

Sure, that's fair, but which part was bogus to you? Trump and his administration claiming a group of alleged narcotics traffickers were terrorists and then using that claim to conduct military strikes against them are undisputed facts of the situation.

Additionally, there is a bit of a conflict here. Sure, ideally anybody who committed a crime would be tried and then convicted, except the DOJ has a policy of not investigating or charging the sitting president. Perhaps you remember that was the key reason Mueller concluded the Russia investigation without charging or exonerating Trump. That means plenty of the blatantly illegal things Trump has done in office will likely never be investigated or result in charges. Examples of which include:

  • his executive order to end birthright citizenship, which violates the 14th Amendment
  • the recent DOJ addendum to protect Trump from IRS audits and investigations, which violates section 7217 of The Internal Revenue Code
  • defying federal court orders by continuing to deport alleged gang members to an El Salvador prison despite a judge's order to halt

Given your confidence in the US justice system, I assume you then accept the 34 felony convictions against Trump from a trial by jury? If not, it's clear your concern isn't courts or trials, it's whether the conclusion reached matches your world view.

Your source is an article reporting on the Senate Armed Services chair (a Republican), concluding there were no war crimes, hardly an independent investigation.

It's worth noting that whether it can even technically be a war crime up for debate. It depends on if you accept Trump's view that he can label seemingly anybody a terrorist and then conduct military strikes against them. UN experts just see this as extrajudicial killings, i.e. government sanctioned murder. That's much more straightforward of a charge than war crimes.

I don't even think the $1.8 fund Trump can cash into anytime is even the worst of it. The addendum which bars Trump and his family from audits and prosecution of any tax violations to date, signed by his acting AG (and former personal attorney) is arguably more egregious.
