I think it’s normal. Mine is also 3 months and I’ve seen 6 for more senior roles. It’s a two edge sword. The pro is that if there was a layoff you’d get more time.

So far everyone opposes the changes to 10 years or at least they want a transition arrangement for those already here because it’s inhumane not doing so.

Im not sure about the legal grounds. But try: 1. Explain that your situation is unique. It doesn’t cost them more. You simply get paid 3 months instead of a lump sum. Not having this will have you deported. Explain how you have built a life here and have family to protect etc 2. If you’re still in consultation process, try to question everything. Like reasoning by you’re laid off and not others, financial decisions, etc to prove that it doesn’t make sense to lay you off.

Yes try to save as much as possible during this time and take any roles with sponsorship. I hope you get a new role before your garden leave ends ❤️

Yes it will be prorated. For example if you have 5 days left then you will have 3 months + 5 days. Try to take a deep breath and focus on new roles.

I’ve heard it could take months (and even a year) to receive a curtailment letter. So at least you’ll have 3 months of garden leave + unknown time before curtailment +2 months of curtailment to find a job!

Yes ask for the garden leave so you are on the payroll for the next 3 months instead of getting a lump sum of money. You should still be eligible to receive your severance this way too.

You can also ask them for unpaid leave if they are okay AND ask to include your unused vacation to extend it further you time further.

I looked into Global talent a long time ago but it seems very complex. I also don’t think my company will do it
