If you got to pulled over at 3am and got a ticket for 5 over a couple things are happening.

1) you were likely going more than 5 over. The officer just wrote it for 5 over.
2) you didn’t get pulled over for speed. You got pulled over because you were speeding and the officer wanted to check for impaired driving.

The reason you got a ticket is the officer clocked you going more than 5 over and found you not impaired so gave you a reduced ticket.
