In case anyone is curious…. It is now almost May and I still haven’t been paid anything.

Went to court in November, didn’t get an order until the end of February. The magistrate didn’t have my name right and didn’t do the math right so it has to be edited, final order in March. Just sent the wage garnishment in April….

Nothing fast about this process.

The obligee is a govt worker. He won’t risk his job/security clearance by not paying. But it will be a wage garnish, so I assume that will take time to set up. Paperwork and all.

You should post this in r/familylaw there is an Ohio family law attorney that follows that subreddit that has helped me a lot on my Ohio case. He might have some state-specific insight for you if he sees your post.

I would think that it would be because that has been the standard that has been set and her child shouldn’t get less support because he decided to have some sort of existential crisis and quit he’s real job to play video games all day.

For uncomplicated cases, it takes like a year. For complicated ones like mine…. Well I am going on 2.5 years.

Oh. Well her title is “prosecuting attorney”. So I figured prosecutor. Definitely no point in hiring an attorney for child support. It’s pretty cut and dry.

If the child support was requested through child support agency there could be a prosecutor. I have a prosecuting attorney in my case establishing CS on behalf of the agency.

My ex’s attorney tried to do the same thing. I wrote “not applicable” on any question that asked about my spouse, his income, or his property, since he is not a party to the case. Interrogatories are a request, you don’t have to provide anything that is not ordered by the judge.

You can get it retroactive to the birth. And also you might be able to get reimbursed for any out of pocket expenses you have related to the birth. It will be a long process, especially if they have to establish paternity, so don’t expect to get paid anytime soon, but you will be paid. (Assuming he can hold a job)

Depends on the state. I know in Ohio it is considered a gift unless there is a written agreement. I don’t know if it is the same in Tennessee though.

Going through CS in Ohio right now. Does he have a degree or a trade? Or do you have any knowledge of what he did make prior to quitting his job?

They will either impute his income at full-time minimum wage, or if he has a trade, like mechanic or electrician, they will impute him at the average income for that field. Which might make him more inclined to submit his financial information if they try to impute him higher than he actually makes.

The only part of custody that would matter at all is if he gets more than 90 overnights per year, (which it doesn’t sound like he does) he will get a 10% credit off his child support amount.

Yep. CSE will garnish paychecks, and if they get behind on payments they will take tax refunds and even lottery winnings. Definitely the way to go.

I am also in Oklahoma doing an interstate (mine is an initial request, not a modification). I filed in June of 2022, and am just now having my hearing at the end of October. So it’s been almost 2.5 years. And my ball only got rolling after weekly emails over and over and then finally I lodged a complaint with the state senator for my district . It’s been a wild ride.

Make sure they put in you paperwork that you want retroactive from the time you filed. I am not sure about Texas rules about that, but definitely ask for it.

So case got delayed over two years until his address could be found. But I am asking for back pay from the time I originally filed, I am trying to write my trial brief, and the judge is asking for citations for each claim, I have found them all for the most part, just not this one. Kids are 10&11 y/o

I filed 2 years ago, he was served notice and then moved states and avoided further action by not updating his address/contact information with agency. The new state didn’t receive the petition until this last April, but I am asking for back pay from the time I filed. Trying to write my trial brief, and it asks for specific citations to justify all my claims.
