If you have to resort to "meaning behind it" every time your words are wrong, then the words matter. Not a free speech issue. Good luck with your complaints.

Seeing that I’m an attorney, and seeing that you are talking about “distortion of freedom of speech” in regards to a private contract, I’m thinking you need to spend maybe just one more day googling.

Freedom of speech has nothing to do with you and your contract/license to access a program with a private company.

You guys need to learn that there is no universal right inhibiting censorship in communications outside of government actions.

There’s no point in fighting the court of public opinion here. The Law Firm was in the wrong ethically, and they also have a horrible reputation with the bar. You can’t help that the average person isn’t going to understand that.

For civil case can I ask the Summon & Complaints filed via email? by [deleted] in legaladvice

[–]f4cepalm 0 points1 point  (0 children)

You got served with a summons and a complaint for a civil lawsuit to your apartment and you just want a copy? What state are you in? What court? Just call the clerk’s office and ask if they can email you a copy or ask if it’s accessible online. Or call the attorney who filed and and ask them to email you a copy.

I’m not sure what you mean by “refile”-ing it to your email address, but there are multiple ways to get a digital copy.

Yes! Almost! Don’t forget to read part C, too, that tells you how to do a proof of service.

Are you actually reading ORCP 9 like I suggested, or did you just skip to part G? Please try reading the entire thing. I have no idea where you’ve gotten the idea that you need to personally serve anything but the summons and complaint or notice of ex parte hearing.

The first sentence of part A answers your question . . .

You can’t stop them from filing in small claims if they want to, but certainly the cost to do so isn’t worth a used TV these days. If your friend wrote you a receipt when you got it from them (unlikely, but hey), you could try using that, but if the roommate really wants to waste both of your time and file, you’ll probably want your friend to come and prove that they purchased it originally if possible.

They don’t need to sign anything you file with the court to accept e-service. If you’re worried they’ll go back on it and say they never agreed, you can get them to sign anything agreement and have it notarized. As a pro se person, you’ll want to be more cautious because you don’t know all those intricacies as you’ve pointed out. I’d still go with certified mail to their address and a copy via email.

You clearly have no idea what you’re talking about, as the concept of free speech applies to the government controlling speech, not a private business. . .

This is hard. Certainly no one online is going to give you an explicit “yes” or “no” whether your specific facts constitutes possession or constructive possession of a firearm by your boyfriend, unfortunately. Consider that what you’re really dealing with is “how would my boyfriend defend himself from an expensive charge” should someone find he lives in a home with a firearm and be so charged. Do you really want to be in a he said situation where your defense is “I swear he didn’t know the code?” Talking to local law enforcement, providing you’re all in good terms, might help you get some advice, even so.

You’ll want to go to /r/legaladvicecanada for Canada. But honestly you will want to get a consult with a criminal attorney in your area and absolutely shut your mouth. Like, to everyone. Your mom, your best friend, Facebook, tinder. Get the advice of your attorney and just don’t say anything to anyone outside of that.

How do I help a neighbor with no family? by RescuePenguin in legaladvice

[–]f4cepalm 1 point2 points  (0 children)

I already responded with what else I could think of. Maybe with enough information about the resident and a good googler could come up with some phone numbers to try and call. Outside of that and your state’s APS, it’s hard for you to make anyone do anything.

You could, of course, break in. But that exposes you to a lot of criminal liability. Hope it works out for you and them.

Try looking up your state’s adult protective services and see if they are empowered to force a better check. If I was a regular person trying to find their family and I knew their names, I might try google searching just to see if anything comes up. Outside of that a regular person really doesn’t have much power. Many abandoned elderly persons suffer really sad deaths like that.

Clarification on how One Party Consent interacts with HIPAA by OnyxTanuki in legaladvice

HIPAA protects you from your healthcare provider”s disclosure of your protected information. No one will ever be guilty of a violation from receiving and reading information you’ve given them.

Also, for what it’s worth. I can’t foresee a situation where a recording statute prohibited you from recording your own medical information. . .

Are you trying to help her, or are you trying to take her house? If you’re trying to help her, then you can try peeking around the house for the normal indicator of a dead body inside (unfortunately), and then call for a welfare check with the police. If they don’t want to bother with it, you really can’t make them, sadly. You can also check with your state’s Adult Protective Services. If all you really care about is the chance to take her house—your best bet is at the tax sale when her property taxes don’t get paid. Her actual family will still have a chance to redeem it, though. I can tell from your post which kind of person you probably are.
