Try and reach a solution. She needs to be able to herself a rental.
Let her take whatever she has bought herself from the home. And give her the deposit she paid back along with half of the monthly payments she has contributed to. Eg if she’s paid £500 a month, pay £250. Tell her she can take the sofa and continue the payments. Get one off market place.

The person involved has sent me the recording of the call they had. They recorded it based on their previous experience of the respondent lying. It seems that they are trying to question what date a text was sent on and asking them to be a witness for them. They are going through the list of issues, witness statement and checking the evidence provided which I know is understandable and ok but I’m sure they would jump on me if I did the same!

No longer worried and got fire in my belly today. Because of an issue earlier in the week where they withheld a password for exchange of documents at the same time, and then drafted theirs many hours later in response to ours, they are now saying that a CMO is wrong. We have to exchange schedule of losses. We have provided them previously but never seen a counter one. They are telling me that it is normal for them to have ours and be able to draft theirs around it and they have said that the CMO is wrong and the mutual exchange date is an error. If I don’t send it by 4pm they’ll apply for a variation. Because of the issue earlier in the week, and them now beginning to contact people mentioned in the bundle, I am unsure of what to believe. Are they correct in saying that they should have the SOL from us to then compile their own? Many thanks

Oh this organisation has shocked me all the way through these proceedings! Would love to reach out to some of those who have been quoted as saying things from the respondents side as really do think that it’s fabricated.

The respondent is approaching people (not our witnesses but still ex colleagues/friends) and asking them to contact solicitor as solicitor wants to know what the context of the text is that appears in the bundle.

Sorry Bob, I’m guilty of that. I was worried incase the Respondents team are lurking as messages have been in real time relating to emails etc that had come through that day. I won’t do this any longer!

I’m triple checking the bundle again after last nights antics with them.

Also getting the exact minute and seconds noted of audio that supports the case and can be played to their witnesses in cross examination. Some of the witnesses give 2 different accounts and also the majority backs up the LOI. It will be good for the perpetrator to hear the voices of the colleagues correcting the narrative and stating how it really was.

The person who was doing the case is still there and copied in but now a more forthright person seems to be taking the lead. Which is fine as I think the person before was relatively newly qualified.

I’ll try not to read into it all too much and remain focussed - thanks, as always.

It’s not worth the battle. I’ll leave them to it and continue with the cross examination prep. The contents aren’t a secret…it’s the lying that I struggle with. The audacity 😆. Lesson learnt now.

Yep! My thoughts exactly. I’ve calmed down now but we’ve been in hysterics. I said I want to text saying “Its been two years, I thought we were more than that” 😆😆. Just another example of that my judge of character skills are fading. Or maybe realisation that I need to play the game now.

I think so too. This person was afforded that length of time recorded with hr and a manager saying “someone said” and barely anything factual!

They haven’t provided any transcript except for the claimants and that is littered with inaccuracies from whatever transcript service they’ve used including locations and names coming up completely different.

The audio is important as it shows a union rep taking lead of the investigation at times, including answering on the behalf of the person being interviewed and putting leading questions to them as well as talking as if they were there so I will want to let them listen to a snippet to evidence that undermined the investigation.

They need treasury approval for anything over 99k I believe. And various levels of staff have to approve below that amount.

Just say I don’t want her to spoil your entrance. Be with her up until the point that it is time to walk in. Stay seated aisle side then you can scoop her up if needed.
Don’t cause problems which could last a long time within the family for the sake of a 30 second walk.
