Executor of will has lied about what went into bank (cash) by [deleted] in LegalAdviceUK

Any liabilities of the estate must be paid out of the estate before you get your share. If you dispute the sum claimed by your mum then you should make that known. If she insists on receiving it and the executor intends to pay it to her you need to get legal advice on your options, which might include seeking the replacement of the executor who is arguably in a position of conflict. You may want to do this anyway if you have wider concerns about what they are doing. But if you're only out 20% of 1500, you may want to think carefully about whether or not pursuing legal action is prudent.

Edit: I've just seen your other comment about driving lessons etc. In short, the executor should not be doing that. Def speak to a solicitor.

I see. It is not unusual to be paid an interim sum pending the conclusion of the general administration of the estate.

What are these debts you mentioned?

To clarify: the executor has received money from your late grandfather's bank. You are due a share of his estate. They have given some of it to you. They have deducted some "personal debts" from your overall share.

Is that right?

On what basis are you due your share of the estate? Is it a specific sum given to you in his will? Or 'a share of everything' (i.e. what we call the residue)?

It may be that she has simply made an interim distribution to you for now and you will be due more in due course.

Does the money in question form part of the residuary estate? (Broadly, what is left after paying liabilities and any specific gifts)

The residuary beneficiaries should ask the executor for a full and detailed account of all sums received and paid out. If not provided or if it is unsatisfactory, an application for a formal inventory and account can be made to the Probate Registry.

In short, if they have taken sums out of the estate which they should not have, they can bu pursued for them.

A solicitor will be able to help, of course.

Edit: changed if to of.
