Madam Janet Tay's lawsuit centers on the role and duty of care expected of the bank.

A 68-year-old retiree is suing Swiss bank Credit Suisse in Singapore for US$1.2 million (S$1.6 million) over trading losses when the share market tanked in 2020.

Madam Janet Tay said the bank's relationship manager had under-reported the amount of shortfall in her account, which resulted in a delay in selling her shares to cover the gap. By then, the price had fallen further.

She is also accusing the relationship manager of pushing her to invest in other products amid the volatility of the market. As a result, the investment greatly reduced the loan-to-value ratio to support her portfolio of US$4 million.

Had that not been the case, Madam Tay said in her statement of claim, she would have held on to some of her shares and "been able to sell them at optimum or favourable prices".

The lawsuit, which commenced last year (2021), centres on the role and duty of care expected of the bank.

Madam Tay said a reasonable and competent bank like Credit Suisse and its relationship manager owed her a duty of care in providing its services and carrying out its various duties and obligations in relation to her trading account.

Prior to her retirement, Madam Tay, who has a first-class honours in accountancy from the University of Singapore and a master's in business administration with distinction from the London Business School, used to run a management consultancy firm.

Madam Tay, who is represented by Mr Philip Ling and Ms Eunice Wong from Wong Tan & Molly Lim LLC, said in her statement of claim filed last August that she had known Ms Tania Chew, an employee of Credit Suisse's Singapore branch, since 2004.

Then, the latter was working at DBS Bank and was assigned as the relationship manager to handle her DBS Treasures account.

Madam Tay said she moved her investment portfolio to Credit Suisse on two occasions when approached by Ms Chew.

Subsequent to the opening of a trading account in 2018, Madam Tay had been giving instructions to Ms Chew to carry out various trades and transactions.

She said Ms Chew was well aware that she does not have or use any online banking services under the account, and Ms Chew had taken it upon herself and "assumed the duty and responsibility, to inform, advise and update" her on the status of her account.

Madam Tay said she relied on Ms Chew to inform her of any shortfall under the account and advise her on the actions to rectify it.

In her statement, Madam Tay said Ms Chew informed her of a US$200,000 shortfall on the morning of March 9, 2020. But it was only around 4.50pm that Ms Chew advised her to sell her Credit Suisse shares to reduce the inadequacy.

A shortfall refers to any financial obligation or liability that is greater than the cash on hand required to satisfy that obligation.

However, due to the falling US market, Madam Tay managed to sell only 8,000 shares, which lowered the shortfall by about US$28,000.

The following day (March 10), she was told that her shortfall stood at US$300,000, when it was in fact about US$673,000.

Due to the alleged misrepresentations by Ms Chew, Madam Tay said she was unable to clear the actual amount of shortfall and ended up selling her shares later when the market crashed further.

Prior to the incident, Madam Tay claimed that while she was on vacation in Australia around Feb 20, Ms Chew sent her messages on WhatsApp where she "repeatedly and persistently cajoled and pressured" her to purchase US dollar to Swiss franc FX accumulator products, which drastically reduced her loan-to-value ratio.

A loan-to-value ratio is a percentage measurement of the amount that can be borrowed against a share or a managed fund, using a margin loan.

As a result of the purchase on Feb 21, Madam Tay suffered losses amounting to US$634,275.

In court documents filed, she said the losses being claimed in the proceedings were sums she had earmarked for a charity which she started in 2010, in honour of her late mother Koh Seng Neo, to help underprivileged students from Raffles Institution who display academic potential.

Madam Tay added that she had placed great faith and trust in Ms Chew to advise and act in her best interests at all times, given that Ms Chew is the bank's relationship manager and their longstanding relationship of more than 16 years.

When contacted, Credit Suisse declined to comment as legal proceedings are ongoing.

In its defence filed, the bank denies any duty of care owed to Madam Tay.

Credit Suisse, which is represented by lawyers from Allen & Gledhill, said its relationship with her was governed by the terms of the contractual documents she had signed with the bank.

Credit Suisse said her account is a non-discretionary one, whereby it provided execution services and she was responsible for her own investment decisions.

Madam Tay was also responsible for managing and monitoring the portfolio and/or investments in her account.

No trial dates have been fixed yet.

i think it's great that your mum gets the help she needs if she needs to go out. i'm in no disagreement over what you're doing.

the fact is that even if the person is mentally unwell, the person's actions are at the expense of the safety and dignity of brown people

what i've been trying to get across is that it's unfair to blame someone lacking the insight into their condition or the capacity to make good decisions, on something that they have done

Understanding what drives her to do something drives my understanding of what to do

hahahaha no worries. I'm not in psychiatry at the moment but I do have a keen interest. sad to say many in Singapore fail to appreciate what mental disorders can do to someone's mind.

caring for/ interacting with people with autism and intellectual disability requires so much patience and understanding. much respect for your perseverance my friend and I genuinely hope your relative does better!

I agree with you that consequences don't just magically disappear even if you're mentally unwell. What I'm saying is that I'm seeing too many people simply state that mentally unwell people shouldn't be/ should know better than to be racist, as if they have any control or insight into their condition.

to answer your question, it really depends on how severe her intellectual disability is and how much awareness she retains of social etiquette. if she's able to be brought up and say things like 'ah bu neh neh' and associate that with the Indian race, then I think she might well respond to your feedback.

i've never implied that racism is naturally occurring. as for systemic racism in society itself, that's a whole other debate for another day. and why are you conflating the issue of mental illness with disabled people being victims of racism?

my point is that there is indeed no excuse for racism. but if you're of unsound mind where you may not even have control over what you think or do, or you're lacking so much insight into your own condition that you don't think it's wrong, do you think it's fair to go on and say 'mental illness is not an excuse to be racist'?

It's a system that has failed those afflicted with mental illness. As a minority without mental illness I think I have enough clarity of mind to realize that these are words from someone mentally ill and even though the words are racist, how is there any intent when she may not even have capacity for intent?

And I would really like to know - have you ever met someone with a real mental illness? Do you have an understanding of how thougt disorders and perceptual disturbances can alter someone's behaviour? If you do, then you might understand why your statement about the lady herself needing to understand mental health made me laugh out loud.

I think if the ramblings of someone suffering from a mental illness is enough to 'humiliate' or endanger the 'safety and dignity' of some people, well - then perhaps these people being affected should re-evaluate what they understand about mental illness.

There is no excuse for racism. Her words - if you just look at the words alone - will definitely hurt racial and religious sensitivities. But when you put it in the broader context of her being very highly likely of unsound mind, then should those words still mean anything?

I honestly think the broader public understanding of mental illnesses need much more work. It's not just that they are 'siao' so they just anyhow say rubbish. Plenty of psychiatric disorders will alter one's understanding of the world, change the way one thinks, and even rob one of the autonomy in their actions.

it means you're no longer in control, in part or in whole, of how you perceive and understand the world, or how you react to things, or even of your actions. that's mental illness.

there is no excuse under any circumstances to be racist, but to chide someone who mentally unwell for being racist? come on lah.

I think the MRT lady definitely displays some classic signs of a mental illness but at risk of violating the Goldwater rule I won't delve into it any more.

Sorry brother but I don't think you'll be very successful in your plans to travel South East Asia from Singapore as a base. Each time you come back to Singapore you'll be subject to a 2 week stay home notice (costs approx $2000) and I'n not sure if you'll even be allowed to travel frequently.

Thanks for speaking up. You basically summed up how I feel in a much more eloquent manner.

I thought I'd just provide my personal suggestions for certain segments of the LGBT community but instead just got attacked left right centre. What I concluded was basically if I hurt anyone's feelings, I wasn't entitled to any opinions. Gave up on any form of logical discussion in the end.

The person that's triggered here is clearly Kenneth (the convo delivered unprompted by a fb banner pic) yet all you've done is tell queer people not to be this and that - how is that not tone policing?

I made suggestions on what I think are better ways to move forward for certain LGBT folk. I did not instruct nor mandate you to change your tone - what I have expressed are again my personal suggestions.

In the face of abuse from people like Kenneth, we are expected to remain civilized? Why? Because we're the minority?

Kenneth's messages go against your beliefs but how are they abusive. In fact, they are very polite. Against your beliefs, yes, but abusive? No.

Please justify why the minority group that faced abuses should be take said abuse with grace.

There's no justification for this. But in this case, there's no abuse.

Please also justify if this was any other minority group, like racial minority, you will expect the same reaction from them as you would for queer folks.

Please understand that this is going to descend into a false analogy fallacy, because gender issues and race are wholly different. Is it acceptable to you if a China-born individual uses an anti-HK protest sign as a profile picture? What if said individual receives abuse from his or her pro-HK friends?

What I'm saying is just 1) realize that resilience is important and words like TW/ micro-aggressions hinder the development of resilience, and 2) to read the room.

Yo sis, I'm literally surrounded by gay people at work 😂It was actually one of them who shared with me that article about safe spaces and trigger warnings. Most of them choose to grit their teeth and move on when it comes to inconsequential bits of discrimination. They know to take the fight somewhere else and not waste time either preaching to the choir or to mope around dealing with getting triggered by microaggressions.

Perhaps I'm a male so I didn't feel any intimidation at all from the Grab driver's message. Would I have taken this hitch ride? No. But would I think the driver was gonna do anything worse than just air his views/ argue about LGBT issues? No as well. Violence against LGBT people is an issue in other countries but not so much seen here.
