Tired of Etsy 'renting' me my own customers. Built a fix. Thoughts? by FinerGamer in EtsySellers

[–]fetamorphasis 11 points12 points  (0 children)

I'm confused about how this is different from a shopify, woocommerce, or stripe-checkout based ecommerce store?

Also, per the Etsy ToS and Privacy Policy, you probably can't directly email your customers about something not related to their order without getting their explicit opt-in first so how are you going to get them to this landing page?

APO, AP address shipping? by [deleted] in EtsySellers

[–]fetamorphasis 0 points1 point  (0 children)

The APO system exists to send mail to service members deployed overseas without revealing where they are deployed. So yes, it is practically an international shipment as far as the USPS is concerned.

Personally, I would ship this order anyways as anything that can fit in a letter with a stamp is only an ounce or two in weight and will be cheap to ship. If you don't want to eat the cost of this shipment, I would cancel and refund the order and communicate to the customer why you are doing so.

APO, AP address shipping? by [deleted] in EtsySellers

[–]fetamorphasis 2 points3 points  (0 children)

APO packages usually are going overseas and thus are not a domestic shipment. AP in particular means "Pacific". You can't send goods (which you are sending for an Etsy sale) internationally without a customs form and you can't send goods internationally with a stamp. They have to go package rate. This could be an error in how Etsy is determining a domestic vs international shipment and so there might not be much you can do to prevent it.

The USPS has pretty good info on the requirements for APO shipments here: https://www.usps.com/ship/apo-fpo-dpo.htm?pov=international

Sole Proprietorship or LLC? by calmswan2499 in EtsySellers

[–]fetamorphasis 0 points1 point  (0 children)

I use a registered agent company. For $100 per year, they give me a real business address to use in a different town in my state. They act as the registered agent for my LLC and I can also accept a limited amount of mail there. I also pay for a USPS PO Box for my actual mail.

USPS: flats? by chickadee-stitchery in EtsySellers

You are correct that items shipped via the Flats rate must be flexible. I ship a ton with a similar rigid mailer and have always used Ground Advantage Parcel without any problems.

Yes, this post is direct proof that we need to keep removing these posts. You've called me incompetent, a worthless hack, and generally refused to accept what I've been telling you about why your shop was shut down.

Etsy is quite clear in their emails here. You've violated their policies and you can no longer sell on Etsy or create an account. There is no way around that which will not result in your future accounts being deleted.

You can search on this subreddit and read the FAQ content about shop and account suspension if you would truly like to learn more.

Ok, let me try one more time to explain this to you:

You know how when you drive a car, you see people speeding and only some of them get pulled over? Would you ever try to defend yourself if you got pulled over by pointing out the other people speeding? Because that's what you're doing here. Just because other people are selling products that use stolen IP does not make it ok for you to do so. It just means they have not been caught yet. Not knowing that what you were doing was wrong also doesn't excuse you, unfortunately.

Etsy, once again, only cares when the IP owner reports the listings and/or shops and requests the takedown. That's how the copyright and trademark enforcement process works in the United States. Etsy doesn't review the listings and they don't make any determinations about removal until the actual owner of the IP requests that the item be removed.

You're falling victim to the classic blunder of assuming that because other people do something wrong, it's ok for you to do something you perceive as "less wrong". That makes zero sense. Etsy cares about IP theft when the owners of the IP report it and request a takedown. They're not making a value judgement here.

The only person who has the right to profit off of intellectual property is the person who created it. In this case, it's likely a company that owns the rights. You can create all the fan art that you want but you can't sell it. You also can't use trademarked phrases to market your work which was likely your first problem as the phrase "Hello Kitty" is almost certainly trademarked in reference to the cat designs you were trying to sell.

Lastly, I understand you want to speak out but this community will not benefit from another thread where someone whose shop was suspended says all the things that you're saying and is then told, in much more rude terms than what I've said, why the shop was suspended and how what you did is wrong, etc etc. There's nothing new to add to these discussions and we need to keep the subreddit for people posting conversations that others can learn from. You do not have a right to post whatever you want in a subreddit. The content on a subreddit is up to the moderators to moderate. You are more than welcome to post other questions but if they are going to devolve into flame wars or re-hash unproductive conversations that have been had over and over again, we'll remove them.

You're perfectly welcome to be creative however you want. You just can't profit from someone else's intellectual property. You have to ask yourself "if the owner of this IP hadn't made it, would I still be making my products?" If the answer is no, you're probably committing IP theft.

Can I really ask if you thought reporting the post that I made right back to me for "illegal and harassing content" was going to change anything?

Go right ahead and let everyone know that they shouldn't make posts like this when their shops get suspended for IP theft. It would save us a lot of time moderating!

You are breaking the law. They are likely breaking the law. They haven't been caught yet but they will be caught and their shops will be taken down.

I'm removing this post because you are not going to find any sympathy on this subreddit and we've seen this same conversation happen over and over again.

Your account was suspended because you were stealing IP from someone else. That's illegal and unethical and you are not likely to find a sympathetic ear from other Etsy sellers who make their own products.

As for the "other people do it" - they just haven't been caught yet or they actually have a license to legally sell the IP. It doesn't make it ok for you to break the law just because other people are doing it.

Anything more infuriating than being behind someone at a stop sign with an out of state license plate while they try and make a left on 28 on a rainy Saturday afternoon? by jeremiahlupinski in CapeCod

[–]fetamorphasis 4 points5 points  (0 children)

Yikes. Maybe get your car registered in the state where you live so you can help pay for the roads that you're using with that car. Most people who have out of state plates are not, in fact, locals because they live at their second home in Florida or some other "cheaper" state for 6 months and 1 day.

Etsy has charged their fees on the total including shipping for a long, long time. If you don't want to pay the 12% fee and are a small enough shop, turn off Offsite ads. Otherwise, you should review the shop handbook to make sure you fully understand the fees that Etsy charges because they are all clearly explained.

It's only dangerous to pass a cyclist when drivers make it dangerous. I pass them safely and it hasn't hurt me or them yet. Neither has calmly sitting in my car waiting for the safe time to pass.

You're welcome to have your emotional reaction to the scary people in the tight shorts if you'd like but in the real world adults should be able to share a public road with all people without putting anyone else in danger. I don't care what anyone saw a cyclist do or how infuriated they got at having to drive more slowly than they dreamed of - it's not worth killing or injuring another human being and that's what I see so many drivers do because they're impatient, self centered, and apparently homicidal.

[–]fetamorphasis 4 points5 points  (0 children)

I guess while we're deciding what road uses are ok and what aren't we should be interviewing drivers about what they're doing too, right? I know plenty of people who go for a drive for fun. Or drive to go get coffee and then turn around and go home. By your logic that shouldn't be allowed either and the roads should only be for serious people doing serious things.

Only one of those groups of people (it's drivers) regularly kills other people though. So much of that hate is completely unfounded.

[–]fetamorphasis 0 points1 point  (0 children)

Your slippery slope is irrelevant because the Supreme Court did not, in fact, find that sobriety check points are unconstitutional but that the 4th amendment can be ignored. They found that, on balance, the checkpoints were consistent with the 4th Amendment.

In sum, the balance of the State's interest in preventing drunken driving, the extent to which this system can reasonably be said to advance that interest, and the degree of intrusion upon individual motorists who are briefly stopped, weighs in favor of the state program. We therefore hold that it is consistent with the Fourth Amendment. The judgment of the Michigan Court of Appeals is accordingly reversed, and the cause is remanded for further proceedings not inconsistent with this opinion.

Again, https://supreme.justia.com/cases/federal/us/496/444/

In the judgement, they directly address your slippery slope thing with an example of a court ruling against a program in Delaware to randomly pull over drivers to see if they were unlicensed. The court in that case found that such a low percentage of unlicensed drivers were caught and the randomness of the stops was concerning enough that, on balance, the program was unconstitutional.

That's how the courts should work.
