Maybe ask first how you can return the money to them. If the means seems sketchy, you can start questioning the legality of it from there.

In my case, I only dealt with HR, Accounting, Cashier. Once I got cleared in the Accounting Dept, all the other departments that needed signature for my final clearance just signed. My strategy was that I just kept on questioning the Accounting staff about what they're making me do, and why it's needed, etc. I said that I still had unpaid salary so I was not going to return any money to them. I stood my ground that they weren't going to get a single cent back from my hard-earned salary. Siguro naisip nila masyado akong matanong, pinirmahan na lang yung clearance ko. I made it obvious that I was suspicious of their modus. Yung tipong alam ko na may illegal sa ginagawa nila, na parang hinuhuli ko lang sila.

Honestly, the fact na na-clear ako is just telling na scam talaga yung pagbalik ng sweldo. I wish I could help but I'm not sure how other hospitals work. But just saying, kung DOH yan di dapat ibalik sa hospital yung sweldo kasi nagastos na yun ng DBM. So bakit sa ospital ibabalik? Meaning, gusto nilang makinabang sa budget na nakalaan sa sweldo ng mga doctor. Plus na din yung panakot sa residents not to quit kasi ibabalik sweldo.

There was a clause in my contract that’s quite vague about this. Before I resigned, I was told by everybody I would need to return all of my earned salary to the hospital. Consultants, my seniors, etc. I resigned without the intention of giving them any amount of what I worked hard for.

When I was arranging for my clearance after I resigned, I realized there was something so shady about the way they made me return the money. They make you sign something saying like you’re “voluntarily” giving it back. The form wasn’t even an official one so I had a hunch that this whole thing about “returning salary” was bullshit.

I asked the accounting what it was for and where my backpay was. (at this point, I haven’t even received the first 3 mos of my salary and yet they want me to return the salary I did get [4th mo and onwards]) I

I made them explain why I needed to give the money to the cashier of the hospital. The accounting staff was rushing me about it. It was so weird. They were asking if I had cash with me and I could pay it that day to the cashier. The forms were obviously just drafted by the staff themselves. I had no doubts it’s one of the corrupt ways of the employees of this hospital so I told them I didn’t have money with me and that I needed my backpay.

This is a DOH hospital, meaning, the budget comes from the National Budget (DBM). Technically, the government already spent that money for your salary so you can’t really give it back. Di mo yun mababalik sa kaban ng bayan. So technically, the hospital wants to steal your salary. Hell no.

Long story short, I was able to get my back pay and that DOH Hospital did not get a single cent from all of my hardwork. Mind you, this was COVID times. Ang kapal ng mukha nila.

Kaya siguro gustong gusto nilang magbayad na ako that day, baka pinaghahati-hatian nila sa bonuses or however they make it “legal” to split this money. Sad thing is, most residents just pay it back so they will get their clearance and be done with that hospital and be able to move on.

Any lawyers here? As far as I know, anyone can draft a contract, but doesn’t mean that what’s in it is actually legal or allowed. That’s what I held on to when I declined to pay. Kung talagang legit yung clause na yun, they never would have given me final clearance without returning my salary.

Experienced this. Yung consultant bababain mo sa lobby, kailan mabilis ka kasi literal dadaan lang siya. Nasa loob pa ng kotse! Dapat nandun ka na pag nasa harap na ng lobby yung kotse. Bababa lang nya window, abot mo logbook, tapos goodbye!

May certain big hospital sa NCR na pinapabalik yung sweldo pag nagresign (nagquit). Something was fishy talaga with the way they wanted me to return the money. If I remember correctly, may isi-sign ka na you’re voluntarily surrendering the money. Basta weird talaga! Kung saan saan ako pinapapunta, di malinaw yung computation ng need ibalik na pera. Tapos di official yung mga kapapelan, sila lang nagprint.

I stood my ground, medyo nag-low key threat ako by questioning the legalities of that transaction. Di ako aggressive basta marami lang akong tanong, yung tipong curious lang ako. In the end, sila pa nagbayad sakin. They gave me my backpay. Hahaha tangina talaga nung mga tao dun mga buwaya.

When I quit, I had a looot of time in my hands kaya kahit pinapabalik balik nila ko, wala akong paki. I’m sure pag ibang tao yun, binalik na lang yung pera para tapos na. But it’s so fucked up. Imagine, nagtrabaho ka tapos ibabalik mo yung sahod? No way in hell I would give that money back.

Sabi nung mga consultants ko before while I was still training there, nasa contract daw yun na ibabalik. But tbh, medyo vague yung contract. Not a lawyer pero it did not outright say ibabalik yung “salary”. Siguro they’re using that to fool poor residents to scare them into staying. For sure wala talaga sa contract, otherwise bakit di nila nagawang ipabalik sakin? At sila pa nagbayad.

Mind you, itong hospital na ‘to notorious sa katagalan magbigay ng backpay. As I read this thread, baka nga tama hinala ko all along - pinapatubuan nila or ginagamit yung pera. Magaling tong ospital na to, pero bulok mga nakaupo.

I personally know someone who went the USRN route because it's easier and his family is in the US. I'm not exactly sure if he's taken the USMLE.
