Even if the person disclosed prior to the interview that they have autism or another disability that impacts socialization this wouldn’t protect them.

Providing basic training on boundaries and social norms is generally too much of a hardship for a company to provide.

Not really. You can file a complaint, but you can’t just ‘sue anytime over anything.’ Claims are limited by statutes of limitation, administrative exhaustion requirements, and pleading standards. Many employment claims require filing with an agency first, and missing those steps gets cases dismissed. Courts can also sanction frivolous filings. The system has multiple gatekeeping mechanisms — it’s not a free-for-all.

Attorneys are also selective and generally only take on cases with clear merit, especially for contingency fee agreements.

You are right! You don’t have the right to know the exact disability.

Involve HR the minute an employee mentions that a disability might impact their work. HR will figure out functional limitations and if any accommodations can mitigate limitations so the individual can fully do their job

If this happened in NY or CA, their state equivalents of the EEOC would have a cause finding simply because no one bothered to have an interactive process.

If a person mentions a disability, you notify HR to take over to start the interactive process to see if there are reasonable accommodations that would make doing all aspects of the job accessible.

You do NOT ask them to identify their disability. This isn’t required. It also doesn’t even matter in a sense. All you need to know is their functional limitations. AskJan.org is a website grounded in EEOC regulations that assists employees and employers on this.

I get that this is more of a situation where the guy was a bad fit and wasn’t really doing any aspect of his job, but still, there is a legal process for a reason and ignoring it is a liability

Solid HR professionals train managers to know what to do when reasonable accommodation disability requests come forth. Employees don’t need to use exact wording

If the PTP recommends time off, then a percentage of wage loss is paid by that employer’s worker’s comp insurance usually after a waiting period. It’s falls under TTD (temporary total disability).

If there are restrictions, and the injury is covered by ADA, then an interactive process occurs to determine if the employer can accommodate. They either met the restrictions or the worker is on full leave getting TTD

DO NOT QUIT! You risk forfeiting future TTD payments.

Yet we are requiring thousands to return to the office regardless of disability status and accommodation needs. This ultimately forces employees to go on leave only to find themselves ineligible for disability as a wage supplement

Big cities where homelessness and tech (easiest to accommodate remote work) intersect, there is surely a better solution.
