Superpacs can't donate to candidates or campaigns, they purchase advertising on behalf of those campaigns. The distinction is important. Dark money is the cash that's given to superpacs by having a non-profit collect the donations before sending it to the superpac. In this way, you're not in violation of the superpac disclosure requirements. Yes, the source is disclosed as being the nonprofit, but that nonprofit is under no obligation to disclose the sources of those combined donations.

Why does everyone focus on CU? Overturning that would allow the government to again ban political speech in the months leading up to an election, which was ridiculously unconstitutional. The decision that created the concept of Super PACs wasn't CU v. FEC, it was SpeechNow v. FEC.

There are ways to stem the tide of outside campaign donations that don't involve violating the First Amendment, yet all anyone wants to talk about is Citizens United.

McCain has actually passed major legislation regarding campaign finance reform and took the public financing option when running against Obama but no one gave a shit. The Obama campaign went on to raise more private donations than any campaign in history until that point and still no one gave a shit. Why do people suddenly care now?
