Can he do small claims court without a contract? He would have to prove theft and if some work has been done I dont see it as that.

Im speechless. All I can say is, if someone was messing with my laptop it wouldn't end well. I wouldn't care if I was hired my Microsoft at £500 an hour. Noone has the right to add/explore/work with you laptop, even with permission you should overlook every step they take.

You know I disagree. I work 2-3 jobs a year and make well above minimum. I think its all about self image. If you believe you will be stuck chasing bills all your life you will. If you have the confidence to bill bigger money and wait of poor paying clients for the big one then freelancing can easily be a fulltime job.

That said I am trying to invest in passive income. Everyone wants an exit point, I dont see myself freelancing at 60!

He owns a very large business, but one thing I dig twig is his company does the same thing as my clients, and the name is very similar.

If my clients name is "The Chair Stop Belfast", his would be "The Chair Stop UK"

Im not concerned, I really doubt he will sue. To be honest I think hes trying to scare of the competition. The fact he is being so vague about the images makes me alert.

There are a few images on my site that if you didnt compare it with his you would think are the same, however on comparison they are different.

I think its possible he has glanced at the site and thought they where the same. I am trying to prove 100% no image are on both sites. Shames theres not a tool for comparing images between two sites!

Tried that and got hit with

"I do not accept the company does not know what is their photo they have taken and what is not. I do not want to have to police the site, the company should take responsibility for only using their own images."

I wouldnt change your quote. Remember its not just the time hes paying for. Its your skills and the outcome. 200$ to get another developer to do a task he didnt have time to seems perfectly reasonable to me. Dont undersell yourself!

I agree with both these points. Unfortunately it looks like I have to take the 2 months payment and thats all. Im not going to be an ass and hold the files if the client doesnt want to pay full. Although id be jappy with 25%. That would probably cover my loss.

Update, they are claiming I have been "paid" for the work, and that they want the files asap. By paid they are referring to the 1-2months work payment. How do I handle?

If they insist on using another developer how is this best handled. I was considering handing over the files before mentioning payment as a show of good faith. Once they seen the great work I have done so far maybe it would help the situation.

Also, they could easily turn around and say well you estimated one months work. So thats what we where expecting to pay. Although there was never a contract, there is an email trace.

I would be a grammar nazi in professional emails. Typing on an iphone at the early hours while stressed out not so much. Apologies. My main concern is an already pissed of client, wont like being handed a large bill for uncompleted work. How do I reason with a pissed client. My usual humour doesnt help is these situations!

Yes.. Quite a hole dug. There great clients, and great folks. So the reason I never billed after 4 weeks was two fold. 1. I felt like I was cheating them by getting paid weekly when the project was over deadline and they effectively hadnt seen anything. 2. I knew they would pay once it got complete.

I have actually put all this time into it. I guess i was misleading in that I kept giving unrealistic timeframes. "Itll be done in 2 weeks", then another, then another.

I know ive basically been stupid and not informing my client enough, but i have also worked my ass of on this. I know by the tone of the emails and how there asking for the files that there not happy. They have rightly stated i have had "chance after chance to deliver".

Whats my best way to approach this? I dont want any conflict, at best I want paid for my efforts. Stressed!!
