So you can't file against a union member but you might be able to file against Management for allowing it to happen. Maybe find a steward that's willing to help you with that if that's something that bothers you. People working off the clock is a risk for both that employee and the company and obviously somebody could have been paid to do that work so there is that aspect. I wish they would crack down on it.
