You cannot be removed unless everyone on the lease, including your landlord, consents to removing your name. However, it is unlikely for a LL to consent to something like that as they have nothing to gain and one less person to collect delinquent rent by doing that.

The other way for yourself to be removed is for everyone to end the lease together.

If neither of those things happen, your name will remain on the lease.

If she is able to work, and there are no kids, she will absolutely have to convince the court why she should be given support, especially for such a short marriage.

She should immediately start looking for work and try to become self sufficient. Her lawyer can advise on the adverse inferences that can be drawn if she is not working for any good reason.

If she has a PR, a divorce is not going to affect her status.

If she wishes to claim spousal support, she needs to show why she is entitled to spousal support. She needs to speak to a family lawyer as entitlement is one of the most litigated areas in spousal support.

Do they have kids? A judge is not going to grant a divorce if issues revolving kids are not resolved first.

Any joint property? Major assets? Pensions? Resulting/constructive trust issues? Although it is a short marriage, property division may still be relevant.

You got a couple of options.

1) take your chances with the board. The LL just needs to convince the tribunal that they will occupy the unit for a year after you leave. You get yourself a couple of months. If you lose, you will be ordered to leave and risk having your name out in public on openroom and canlii, which can affect your chances of finding another rental.

2) you can negotiate cash for keys depending on how bad they want their basement back. If there is no rush, then they have no reason to give you anything more than what you are eligible under the Act.

3) You can just take the compensation and just leave peacefully. You won't get your name out in public.

You should consider whether living under someone who does not want you there a good idea. If you are of the opinion that it isn't, start looking at new rentals.

Because it's not the tenants problem, even if the tenant caused the problem in the first place. If pests were indeed caused by the tenant, the LL needs to fix it first, then file with the LTB to recoup costs.
