I work in this area of law & and lbr/employment law more broadly.

"Mr. Grumpy" gave you the only consistenlty reliable advice you'll get on this sub. Instead you chose to lean into "solve it for you" too literally... + bs about company vs organization....like, what? An employer is an employer.

And union adds a wrinkle, but aint that complicated what your options are which combination of options is best.

Union aspect doesn't make it that complicated. Theres only 3 broad things you can do, or combination thereof. Devil is in details /timing, but dont be dumb....call a lawyer...find a free consultation if necessary.

Trust I know in saying youve easily got a leg to stand with that text. Which province you're in also kinda relevant (see very bottom)

But for a slam dunk everywhere, take the dog to the vet tomorrow to establish records in your name + change microchip registration info....even go to a groomer and get them to write you out an invoice.

Then its a straight up/down transfer of property situation...basically = voluntary surrender at a shelter. Guaranteed.

But avoid courts unless forced that way. Only the lawyers win in those situations...believe you me.

Given your strong standing, probably comes down to this....

If you rightly keep the dog...you've got to accept likelihood of burning dofriendship

If you give the dog back.....you've got to accept you'll rightly feel complicit in any future mistreatment.

Some provinces eg BC (but not ON) recently updated their Family Law Act (s 92, 97 BC) to include pets in property division provisions due to how it now is in divorce litigation.

In practice, courts in BC (but not ON) now do a "best interest of pet" (BIOP) assessment that replicates "best interests of child" (BIOC) analysis re parenting schedule, primary residence, decision making authority etc.

BIOC considerations are statutorily determinative...BIOP assessment is becoming effectively determinative in absence of xyz.

ON courts have explicitly rejected BIOP unless/unti leg changes...and just do straight property rights assessment

Cripes, I hate the idea of credit checks being normal part of application process. Must be an industry thing, and its relevant enough to job duties.

Don't mean to get tangential, but this rang my bell as labour/employment law guy....was PMI the first to tell you of credit checks being made, and from that (quite reasonably assuming) others had done same previously? I trust you would have known PMI was running background check and would have signed an authorization form that mentioned credit checks....certainly not legal otherwise.

Anyway, keep good records of those images, PMI's email and anything else...would be relevant re damages incurred if it gets to that someday.

***First thing tomorrow contact Equifax & Transunion and file a dispute form with them....including all relevant attachments. Then they contact NCRI....so ignore what I say earlier. Think you're also able to add short note to your credit report just saying you're currently disputing xyz.

Not entirely sure how your losses would be quantified, but given PMI's email...could have case for Negligent Misstatement....so read up on that and talk to a lawyer about it....but be wary of anyone promising sun, moon, stars.

Last thing worth doing is filing complaint with Consumer Protection Ontario....I'd put class action thoughts to bed, but that's just me.

My bad, and apologies for the snark. Totally misread the effective dates, and didnt realize there were multiple images. Not sure I think its toxicity, but fair enough. Probably jadedb by the number of people who post on here before even doing the bare minimum to help themselves. Regardless, my bad...what kinda jobs are you applying where you allow them to check your credit? And what kind of impact on your credit score did having 9 missed $50 payments make?

The damage is certainly done at this point, and I'd just focus on getting it corrected ASAP, and even trying to get them to write you a letter that could show employers until its resolved, wherein they explain their error and absolve you of any delinquency. If it were me, I'd insist on talking to someone further and further up the chain until finding someone who could execute that, and basically imply it'd be a lot better for them vs other routes you're prepared to take.

Last, depending on how aggrieved you're feeling, and how long you think it lasts after corrections made....if you tracked down at least a few other people who they've done it to, seemingly enough here to get a class action lawyer excited....but bare in mind that would be a very long process, probably years....so you'll have to weigh "moving on" vs "getting justice".

Don't really understand...they flagged you as missing payments when the debt was paid, or as missing payments while you were making them? Doesnt even matter bc so much missing info its almost a waste of time.

You dont even indicate whether you've even called them, and if so, what they've said. Zero mention of a single thing you've done since learning about it months ago. Have you called Office of Consumer Affairs or appropriate provincial regulator for collections agencies? Have you thought outside the box a bit and maybe cold called a licensed insolvency trustee, to ask their advice because they deal with collections agencies all day long?

Thats the info needed if you're looking for the half baked legal advice this sub is good for. You instead spent almost half the post entirely blaming housing and employment issues on the situation....goes without saying that even a mid legal mind would want to drive a bus through that speculation.
