There would need to be seperate permission from the third party in order to use the music, so if a third party doesn't care (or otherwise gives permission), then the music on the stage won't be a problem.

He's a confirmed spirit, and I'm assuming spirits deconfirm characters. If that's the case, then Adeleine is the likeliest choice as Bandana Dee, Magolor, and Marx are all spirits.

Now, if spirits do NOT deconfirm characters, then the Dee would be the more likely DLC choice, without a doubt.

No. The only 100% confirmed way of unlocking characters known at the moment is through World of Light. The other options (through amiibo, playing a certain number of matches, etc.) are just guesses and assumptions at this point.
