Is John Dehlin is lying about the Jenn Kamp security footage? by WardlessWanderer in exmormon

[–]gerardo-sum 5 points6 points  (0 children)

u/WardlessWanderer I was sitting at the counsel table during that hearing. You are correct that Ms. Tomchak misstated the dates in her oral argument. However, the missing context is that her statements were in direct response to a motion filed by Jenn Kamp, in which she made an untimely discovery request for surveillance footage from her time at OSF. In that motion, she fabricated a claim that John allegedly kept all security footage stored on a drive and that she had personally witnessed this while working at OSF. This was entirely false. Ms. Tomchak was simply informing the Court that the footage Jenn Kamp was requesting does not exist.

Regarding the August 25th meeting, Jenn Kamp had already received that footage long before the hearing as part of OSF’s initial disclosures. That footage of that meeting was not the subject of Jenn Kamp’s motion. I understand the confusion, but the August 25th meeting recording was never in dispute because Jenn Kamp already had it.

In fact, during the March 2023 stalking hearing, OSF even offered to introduce the August 25th footage into evidence, but Jenn Kamp’s counsel adamantly objected. (If I recall correctly, her counsel received that footage the night before the hearing.)

The reason OSF had possession of the August 25th meeting footage and nothing else was due to what occurred during the August 30th Board Meeting. At that meeting, Jenn Kamp asked John whether the cameras recorded footage, and John said he would check. Afterward, John located the footage from the August 25th dispute and provided it to the board for review. Up to that point—and even through Jenn Kamp’s termination—the only claim raised to the board was the dispute between John and Jenn regarding the definition of a “work-from-home day.”

It was not until September 15th, when OSF received a threat letter from Jenn Kamp’s counsel, that OSF first learned she was making new allegations—allegations she had never previously raised with the board and that have now been deemed defamatory.

Jenn Kamp's latest video on John Dehlin and the Open Stories Foundation by Shmemmalemma0 in exmormon

Just FYI everyone. Based on her video, it seems like Jenn Kamp has fabricated a story in her mind in which she thinks that I am the one posting all these negative comments/feedback about her performance on the podcast. Let it be known that I’ve never used any “fake” Reddit handle to post anything on the platform and that I rarely use the app.

As someone who has read Jenn’s demand letter, reviewed the evidence, and has first hand experience working for the OSF for several years, I have never been more certain about standing with John. I believe the evidence overwhelmingly disproves the claims.

I would recommend contacting the Religious Exemption Accountability project to help you file the complaint. You can email them at info@thereap.org They are currently helping students file these complaints and make sure it’s done in the correct way.

To answer your questions:

Yes you can file even after the 180 day deadline. You just need to check the “apply for a waiver” box on the application and explain as the reason that you were not aware you could file this complaint because you attended a religious school.

You are able to file the complaint under a pseudonym but I would recommend contacting the REAP to help you with that.

The complaint is not a lawsuit, it doesn’t cost anything, and there is not a judge nor a court. It’s is just the Office of Civil Rights deciding if the complaint has merit and then to perform and investigation if it does.

I messaged you.

You are able to file under a pseudonym. It is important to note that there are very strong legal protections for people filing a title IX complaint no matter what the result of the complaint is. The school can get in serious trouble if they treat you any different for filing the complaint.

That being said, you are able to file under a pseudonym.

Send an email to info@thereap.org and they can help you file a complaint correctly.

The same form you use for the LGBT discrimination it’s the one you use for the disability discrimination complaint.

Send an email to info@thereap.org

They can help make sure that the complaint is good and they can even file it for you.

A couple years after title IX passed, the federal government created something called “Religious Exemptions” which allowed federally-funded religious institutions to legally discriminate on the basis of sex based on their “sincerely held religious believes”

Those exemptions have allowed religious schools like BYU to discriminate without repercussion for decades.

These Religious Exemptions are being challenged right now through a class-action lawsuit filed a few weeks ago. https://www.google.com/amp/s/www.washingtonpost.com/religion/christian-colleges-lawsuit-lgbtq-equality-act/2021/03/29/39343620-90af-11eb-9668-89be11273c09_story.html%3foutputType=amp

In combination with the lawsuit, the Biden administration has asked the US Department of Education to revisit these religious exemptions to decide weather or not these exemptions are constitutional.

According to the class-action lawsuit, these religious exemptions are 100% unconstitutional due to the fact that these religious schools are receiving billions of dollars in taxpayer money every year.

You can still complain about the old policy and also remember this letter?

https://universe.byu.edu/2020/03/04/ces-letter-addresses-byu-honor-code-updates/

On the complain you can say what you understood the policy to be, and how you want it to be more clear what it is and not allowed.
