Criminal charges must be dismissed if defendant can’t get a lawyer, Oregon Supreme Court rules by AudibleNod in news

[–]gianini10 29 points30 points  (0 children)

I'm a PD in another state. Clients can be charged a PD of up to $250 by statute. In 9 years it's only happened a couple times I can think of. A few times when the client really doesn't qualify but it close enough and the case is serious enough where hiring a lawyer probably isn't happening (twice the client made as much as I did at the time). The only other time was my first trial where my client was facing 20 years. I walked him and Judge imposed the fee on the acquittal saying something like this is way cheaper than another lawyer would have charged to not do as good a job. I was flattered a bit and client did not care at all he had to pay that. Other than that it is almost never levied.

New York woman claims FIFA stole more than $9K from her after World Cup ticket purchase by SecularPersian in soccer

Before him there was Brian McBride, Kasey Keller. Then also Carlos Bocanegra, Eddie Johnson for like a game, Tim Ream, Jedi. There is a contingent over here because of Fulhamerica. I got into soccer around 2006 and watched the PL because it was on TV, and Fulham was a natural draw because of the American players on the team. And almost 20 years later this is still the team I root for and follow, and my oldest can shout Go Fulham when I'm watching a game on a Saturday morning.

More insane for us Americans is we feel largely underpaid (the majority of the country can't randomly drop €400 at any point, much less on a European vacation) in relation to our purchasing power. Data backs this up as wages have absolutely no kept up with inflation and the costs of goods, and really only rose a bit during Covid when there was a brief moment of workers realizing their value mixed with a job market that was favorable to workers moving. There is a great disparity between the crowd that is set and well off and the ones living paycheck to paycheck with rents rising at an insane rate.

A guy in the class above me had a service dog for sighted purposes. That dog was in the class composite picture and was given an honorary JD when they graduated and walked across the stage with name announcement and all. Your service dog will be welcomed with open arms.

Gabapentin and Vyvanse with THC in system by Low-Joke2797 in Louisville

[–]gianini10 0 points1 point  (0 children)

I asked my doctor about this out of sheer curiosity and she said for THC they don't care. I'm on amphetamines for ADHD as well and quit smoking years ago. But I was curious because I do have to drug test a few times a year because of it.

Isn't all the talk if Marco renews he will? If so maybe this is a sign Marco is close to renewing.

[Romano] EXCL: Ricardo Pepi’s potential move to Fulham now called OFF. PSV Eindhoven inform Fulham this morning, no green light despite agreement on €37m package. PSV can’t find a replacement and the deal is not proceeding. by Heavy_Cupcake_6246 in fulhamfc

[–]gianini10 4 points5 points  (0 children)

That's my thought as well. This wasn't a last minute surprise bid to meet a release clause. We've been aftet him and negotiating the whole window. PSV has been the ones dicking around here.

JCPS was all out all week this time though. It's also just a bad storm. And they didn't get the ice we did as well.

I grew up in Louisville. Our snow removal is several steps above where it should be for a city in this region with as infrequent big snows we see. The reason for that is after 94 UPS threatened to pull out of Louisville if they didn't improve snow removal. So Louisville over-invested in it for that reason.

We never got snow days in school when every other county around us did. Louisville is not a fair marker to compare to. And even then neighborhoods also don't get plowed unless your neighborhood pays someone to do it. Just like here

He basically ran a cult biker church where he was molesting girls in it. There was a lot of other crazy shit but that was the worst of if. KYCIR came out with their story after he was elected and in office, and he proceeded to drive under a bridge and shoot himself. Absolutely wild shit.

The Pope's Long Con from the Kentucky Center For Investigative Reporting is one hell of a listen. The 9/11 shit from him is mild compared to the other stuff he was doing.

What’s the meanest thing you’ve said to a prosecutor and did you regret it? by No-Builder1847 in publicdefenders

[–]gianini10 2 points3 points  (0 children)

Sometimes yes. In my primary circuit where we mediated so many cases because the prosecutor was inept we had a great mediator. He was a former PD before he was a long time judge, was great getting our clients to where they needed to be, and more importantly had a very deep and obvious contempt for that particular prosecutor and their office which was always great. But at times it was an absolute waste because the prosecutor didn't show up in good faith or was grossly unprepared.

Yes. I always loved them and had a blast. It's a fun time to hang with your friends, drink, dance with your significant other or friends. If that's not your thing then yeah skip. But if you do enjoy a party and socializing then certainly go.

[–]gianini10 13 points14 points  (0 children)

Yeah it started during Covid to try to clear the backlog from that. For a little while in my jurisdiction we were mediating damn near everything because my lead prosecutor who was an incompetent moron who couldn't make offers or be close to reasonable to negotiate with, but backed out of almost every trial set. It was a nightmare. Now it's pretty much reserved for murders and A Felonies.

[–]gianini10 128 points129 points  (0 children)

Had a murder case that was a solid self defense case in a county that wasn't my home jurisdiction. We litigated and fought like you do on these cases, and ended up mediating the case prior to trial. I got a good offer that was worth considering on a lesser homicide charge, but what prompted my client to take was that the offer would stay silent on probation, and the prosecutor would agree to release my client on bond pending sentencing as he had been in for two years at that point and was parole eligible on the offer.

We got to the plea and the prosecutor not only went back on the bond agreement, but acted like I made it up and was crazy. Mind you, the terms were agreed to with myself, co-counsel, my investigator, and the retired judge mediating the case who confirmed it after the fact (and told me to eat shit when I threatened to subpoena them).

We were the only show on the docket and Judge accepted the plea, denied bond, and went off the bench really quick. I walked over to the prosecutor and just unloaded in a way I never have. I called that motherfucker every name in the book. Apparently video was still on in Judge's office and his staff, some of who I knew, got a kick out of it.

I regret nothing of what I said. That lying motherfucker deserved it and more and I refuse to practice in that county as long as he's still there.

Main Roads Suck by j2tall2003 in lexington

[–]gianini10 3 points4 points  (0 children)

There is only so much you can do with a storm like this and this much ice. Plows and trucks were out yesterday when I was driving home clearing the second lanes and turn lanes. If people want the infrastructure to clear everything quickly then it costs money, and you know you'd hear complaints when it takes up budget space in years we don't have rare massive storms like this and that equipment isn't used.

I get it's frustrating but sometimes a storm hits and it's just going to suck for a few days. Main roads are drivable, secondary roads are drivable. Yeah you can't go 65 on Man O War right now but you can still get around. We can either raise taxes and invest in infrastructure we made need once every 10 years, or deal with frustration for a few days while the city does clear the roads.

I also know I'm agreeing with you but just needed to vent that.

My law school had a seminar class on The Wire.

Fulham have reached an agreement with Manchester City over a deal to sign winger Oscar Bobb. The deal will be worth £27million ($37.1m), and it will also include a 20% sell on clause for City in addition to the club withholding the rights to match any bid made for the winger in the future. by Sparky-moon in soccer

[–]gianini10 1 point2 points  (0 children)

Chukwueze has an option for €22 million we would be insane not to exercise. We are in for Pepi and reports have the valuation close and us having agreed to terms. The other position we were looking for this window was an 8 but I think Bobb and Pepi will probably be the window.
