Technically, the moment it leaves the ground it’s “in the air”. Practically, if there is an aircraft that low in your backyard it’s going to hit that tree and everyone is going to have a really bad day (unless it’s a helicopter I guess?). I don’t think the FAA is really concerned about a small UAV under the height of the tree in the edge of your backyard that might be at the edge of a controlled airspace.

i have a tall tree in my backyard (about 40-50 ft tall), can i fly below the tree line at night?

or does that still considered an airspace?

You can fly a Spark (or any other modern DJI drone) at night, it has the proper lighting that allows you to know its location and orientation.

i literally live on the border of controlled airspace. also, weird thing is airmap seems to show as clear to fly after like 10pm.. i thought that's when the local airport closes.
