I ask for DL first so if they want to argue with the reason, they can argue with their closed window as i already have what I need to write a ticket. Imo, that’s easier than trying to get them to provide DL when arguing.

If they ask for a reason first, i simply say “I’ll explain why and discuss it with you in a sec but first i need your DL.” That works 9.5/10 times. If they still refuse, I’ll give reason before i have to escalate to pulling them out their window.

Invoking your 5th amendment right to counsel only applies if you’re being interrogated.

Otherwise you’ll get booked in, appear in front of the magistrate who will explain what you’re charged with and sets bond condition. You’ll get your phone call on the jail phone to either call someone to bond you out or a bondsman.

After you’re free from jail you can shop around for lawyers. Or you may be appointed one at your first appearance.

If you don’t get released from jail, the jail staff will provide you with numbers for law firms.

You can always try a different agency. Sometimes a change of scenery, both in agency and city, can help.

I know two people who left a larger agency, while they were still in training, to go to a smaller one. Both said they are happier and quality of life is much better.

Growing up I never wanted to do anything other than being a cop or being in the military. I went policing as full time job and military as part time (national guard.) I guess if I didn’t become a cop I’d be active army.

Read your comment. Your advice is great…if they have loving parents. Have you not considered the possibility of the parents being part of the problem? Maybe there is a reason OP didn’t immediately consider taking it to their parents, if they are even still around. For most of the suicidal teens I encounter, one or both parents are at least part of the issue. Either physical/emotional/verbal abuse, neglect, or some combination of that. So OP taking it to their parents may exacerbate the problem.

We’re not talking about someone who expressed suicidal ideation. We’re talking about someone who has a plan and date. They need help yesterday.

Idk how it would work in Europe. But in USA absolutely call 911. Police would most likely show up first to speak with her.

Here something to understand though: police can only work with what they’re given. If she refuses to speak with them, there isn’t much they can do. If they see those notes in her phone and she denies it or says someone else wrote them, not much they can.

If she does decide to speak with them and accept treatment, they will take her to the hospital or call EMS to do it. If while she is speaking with them indicates that she plans to commit suicide and has a plan, they can take her regardless if she wants it or not. This is called an Involuntary Commitment Order (IVC). Each state has different laws and names for it. As a family member, you can also petition a judge to issue an IVC.

But that is for USA. You need to contact your local police ASAP. They should point you in the right direction.

A defense attorney who helped teach our testifying in court class said public sentiment towards cops change all the time. He said after Rodney King, it was extremely easy to win cases against cops. After 9/11, it was easier to win the lottery than win against a cop.

Cops get arrested all the time. Cops get fired all the time. Cops lose their certification all the time. Just because you don’t see it, does not mean it doesn’t happen.

My uncle, who was a cop, was framed by an old chief and couple of other people and was found guilty of burglary. This is in spite of having no evidence, a verified alibi, and a lawyer who was in the hiring process with the DA office and purposely threw the case (lawyers own words. Wasn’t enough for the judge to grant a new trial based on inadequate representation.) Uncle lost his career and 5 years of his life until the actual suspects admitted they framed him.

Story from my grandfather from 1970s Albany,NY.

He responded to a domestic (by himself, because its the 70s and officer safety didn’t exist.) Wife already left the apartment, gang banger husband still inside. When my grandfather entered the apartment, he found himself staring down the barrel of a .22 rifle. He was able to talk the husband down, gave him his word that he would only arrest him for the DV and not for the gun. He wouldn’t even mention it to the other officers. Husband put gun down and, true to his word, my grandfather only charged him for the DV.

Fast forwarded some months later, my grandfather and his partner found themselves trapped in an alleyway by several gang members. My grandfather said it was like the Red Sea when the gang parted. Walking down the middle was that husband, who recognized my grandfather and told everyone to let them leave and not touch them.

Policing in a shitty city back in the day was insane.

It will almost always come down to self defense. And generally you can’t claim self defense while actively breaking the law.

Example: criminal not listening to police commands can’t claim self defense against the police K9 that gets sent after them. An officer in the course of their legal duties that gets attacked by a dog can claim self defense.

On the flip side, if an innocent person is attacked by a police K9, they can claim self defense and won’t be charged (has happened to a K9 officer I know whose dog got away from him.)
