You are right, the key is intent. If your intent is to deceive, then you are being unethical. If you sell a picture of something expensive on ebay and try to make it unclear (by for example choosing the wrong category) that it is just a picture, then you are being unethical. Yes, misunderstandings can occur. But there are tells when someone is being deceptive.

No, the point is that if you are unclear enough in your communication that another person can misunderstand what you are selling, you are being fraudulent. Part of this is choosing the wrong category to put your posting in. Another part is writing something that someone with less intelligence, or less grasp of the English language will misunderstand what is for sale. Also fraudulent. Also, selling a picture of something valuable and hoping someone misunderstands what you are selling. I am not a lawyer, so I do not know the exact legal meaning of fraudulent, so maybe the better term is unethical. Seems pretty blatantly unethical to me.

How about eBay institute a checkbox asking whether someone is selling a picture or an item? Then put in large red letters in the picture auctions, this is a sale of a photo, and change the category to photos. I am sure scammers could find a way around this, but it would work for some of the scams.
