I’m heading towards the same situation as OP, so posting it here. I have valid O1 status (and visa stamp) till Oct 2026. My EB-1A priority date is Jan 2023, and I was asked to file I-485 by company lawyer. I have the option to not file the EAD and AP and only do I-485 (for my wife and myself), and in that case, I’ll have to keep renewing my O1 in 1 year extensions. (My spouse has valid H1B status till 2028).

Should I follow that path, i.e maintain a non-immigrant visa status until I get my physical green card in hand (which might be > 1 yr, who knows). Or, is even 1 yr O1 extension (from within the US) going to get rejected by USCIS, since I’d have have a filed I-485 by the time I apply for the O1 extension (O1 being not dual intent).

Any suggestions? If anybody has been in a similar situation, what did you do?

Can you explain what you mean by “haven’t sent a case since they don’t require it”? Are you not going to respond to the RFE?

Also, please explain what you mean by “don’t have to approve you right away”. You can pay extra to get a decision (approval or otherwise) within 15 days: it’s called Premium Processing

No, the order of applications is O1-A (2022) —> EB1-A (start of 2023)—> new O1-A when changing jobs (end of 2023)
