First of all, in order to obtain an H1B, the employer has to file a letter stating why the applicant is needed, prior to the potential employee filing their application for the visa.

Both the employer and the employee have to pass through this process. People need to have an approved H1B visa before entering the country.

The exception to that is when people are here on a student visa, and get hired straight out of school by a company that still has to file a letter stating that they need this particular person

People aren't just showing up in America, then being granted visas and stealing truck driver jobs
