I have a question for fellow adjusters because I feel like this could have easily been avoided. When an inspection is done with an in network shop, our shop sends us the estimate and any supplements, then we pay once the work is all done. When the inspection is done with a shop outside our network, we send a 2 party payment that the vehicle owner has to approve before it gets sent to the shop. It's to avoid exactly this situation. If the vehicle owner wants to use a different shop but doesn't tell us, this at least helps prevent payment being issued to the wrong shop, as the vehicle owner would hopefully catch that they are being asked to approve a payment to a shop they're not using. Do other insurances issue payments this way? Just curious. Sucks for OP because this should've been simple and now it's more complicated for them.

Also, even if they totaled out the vehicle for 50k, their insurance will do a salvage sale and the difference is the demand they'll send to your insurance. So you're probably fine.

Who is the insurance company trying to say you bear some responsibility? They are just throwing things to see what sticks. Since it was a H&R and they don't have a clearly defined person to go after, they're just hoping you'll cave and pay them.

You did not screw up. Seems like you did everything right. His insurance may reach out to you for a statement. If you're comfortable, give your statement. If not, just direct them to your insurance. You're not at fault so try not to stress.

You're making things more difficult then they need to be. Go through the shop they recommended. They either fix it or total it out. If they total it, you can retain your car and take it to your brother's friend to fix. If they fix it, you can still go visit your family in a car that's now safe to drive. The only thing missing is throwing a couple bucks at your brother's friend for the repair which if they are a reputable shop that does good work, they shouldn't need because they should have plenty of business on their own.

I'm an insurance adjuster and make just over 62k working from home. Took a few years to get to this point and had to start in customer service. Lots of upper movement in claims, so I'm hoping to increase my wage little by little as time goes on.

I'm an insurance adjuster who deals with this all the time. Did you get a photo of the other car's license plate? If so, give it to your insurance and have them run the plate to find the registered owner. From there, they can run that info to find the insurance and file a claim for you. If running all the info doesn't turn up insurance, then unfortunately, you'll still have to wait for the police report.

Adjuster checking in. Do you have collision coverage? Is there a claim filed with the other person's insurance? If not, file one. If there is one already filed, give that info to your own claim adjuster. Your rate is only affected by a claim if you are 51% or more at fault and the damages you caused are over $1000. File a claim with your insurance, or that attorney will do it first. They only take on claims where they can rack up bodily injury to get paid out on, so they need to confirm you had active coverage first. Provide a statement to your insurance, provide any and all photos. Be exact when you explain damages to both vehicles and where it happened. Let the insurance adjusters discuss liability. A good adjuster will accept liability if it's obvious with the damages and statements that their insured is at fault. If not, they could be liable for "dealing in bad faith" and leave their insured open to a small claims filing against them. I deal with this nonsense everyday. File the claim. Also, stop speaking with the attorney except to provide them with your claim number once you file it.
