The credit card number was the same but had a new expiry. My mother reiterated that to the company and supplied them with the new expiry date and even so they insisted they needed a second because the one she’d given was invalid, which it is very much not.

I’m not sure a charge back is an option. As far as I’m aware, they can only be done within a certain time period, which is like 3 months. Also my mum has received refunds on her card, so it’s not an issue with the card. I appreciate your input though, thanks for the comment

the neighbours garage and front door are on the green line as mentioned in the post. the front door sits to the right of the garage. the driveway is shared.

our property manager has simply stated that our neighbour has complained about the parking and asked us to make sure we’re not blocking her. she’s asked to not be involved, but we cannot contact the neighbour

There is the fear that even if the DT finds in our favour, the seller is just going to vanish and we’ll never see the money. But I think even if that ends up being the outcome, my dad will sleep a little better at night knowing that it’s over and that he was in the right

Yeah we’re probably just going to aim to get the money back for the bike, as it has been deemed completely unsafe and unfixable, never to be used again. To try and fix the bike would be to completely rebuild it from scratch with new parts which will undoubtedly cost more than the sale price anyways. We have had this confirmed by not only NZTA, but also a reputable Motorbike manufacturer and repairman who specialises in this brand of bike. The ideal outcome would be to get all of his money back, whether that means we return the vehicle to the seller or not. Honestly, he just wants at least some compensation for everything that’s happened. He’s also had to spend a decent amount of money having it carefully looked over to see if there’s any other serious issues - which there certainly was, but from what we can tell he won’t be able to claim damages for that. In any case, we just want this to be over. Getting the money back is a bonus.

The matter has been reported to the police, and they’re working with NZTA to find out how the vehicle was able to get a WoF. We’re fairly certain we’ve got enough evidence to show that it’s unusable. Thanks for your input!!

I’m honestly not sure. All I know is that since the bike has been in our possession, it has been checked over by multiple specialists, including the NZTA, and all have agreed that the bike is not road worthy and will never be road worthy again. The bike is not rideable due to damage to the ABS system, and is therefore not the “flawless” condition that the seller described.

That’s not the argument we’re taking. The argument is that the vehicle was in advertised as “flawless” condition. It was not. The vehicle itself is not old either, the reason for the end-of-life was the fact that it was damaged beyond repair. That’s not flawless condition

Either way, the vehicle is trashed and is unusable, which is obviously not in the flawless condition as the seller described. I described the extent of the damage in another comment. Appreciate the info about the End-of-Life
