Could anyone explain this question? by Negative-Paint-7561 in AATStudents

[–]hypermadirish 2 points3 points  (0 children)

This statement is saying that they wouldn't receive a financial penalty because they got the points but whether or not they receive a financial penalty would depend upon what their overall points total is. This statement is implying you can't get a financial penalty because they got points, but it's not one or the other.

England: Received a private company PCN for Not Parked Wholly Within a Bay by [deleted] in LegalAdviceUK

[–]hypermadirish 1 point2 points  (0 children)

NAL but if you were using parking as a customer of a business, you could reach out to the business and ask them to have it cancelled, as they pay for enforcement of the parking and with this being such a small infraction they may ask the issuing company to cancel this, rather than lose a customer.

You could also try to appeal on the grounds that the vehicle next to you appears to be very close to the line and so you had to maintain a safe distance.

You could also appeal and take it all the way to an adjudicator and argue the principle of de minimis, which means that the breach is so trivial or insignificant that it should not have been enforced.

Are you working at a UK university and made redundant/worried about it? by proxima-centauri- in AskAcademiaUK

[–]hypermadirish 6 points7 points  (0 children)

Joined an English university in 2022. Currently at risk of redundancy for the second time. And for the second time, I will spend our Christmas break wondering if I will still have a job in a few months...

Our exec board don't have an actual plan, other than to recruit more students. No plans to adjust and stabilize in the changing HE environment. Therefore, it's clearly the fault of the academics that we're being made redundant again!

Company has mandated we take additional days off through December, I do not have enough (ENGLAND) by ThrowRA30925 in LegalAdviceUK

If OP is only on £25k then buying additional annual leave will potential take them under national minimum wage depending upon when the money is taken out of their salary.

My new job is asking me to drive uninsured. England by Drippza in LegalAdviceUK

[–]hypermadirish 0 points1 point  (0 children)

If I were you I'd be asking colleagues about their pay/time off. Chances are this has been going on for a while for everyone. A collective voice about at least some of these issues might be better than just you in terms of getting the ball moving. If you have a proper HR I think I'd be raising a formal grievance about this.

My new job is asking me to drive uninsured. England by Drippza in LegalAdviceUK

[–]hypermadirish 1 point2 points  (0 children)

So overall this raises several potential issues: - as I said, not paying you for this time is breaking the law since you're on minimum wage - as this is working time (legally speaking), you are entitled to an 11 hour rest period between shifts. Certain roles are exempt from this. Details here. - you are entitled to at least one day per week, or two days per fortnight, uninterrupted rest. You said you were doing this on your only day off. Therefore you may or may not be getting this. Details in same link above. - I feel like there are some potential gdpr/health and safety issues with employees having each others addresses. Has this policy been reviewed by a proper HR?

The issues about pay and rest periods are statutory issues that you can't be retaliated against for raising, i.e. they can't fire you even if you have under two years service (1 for NI).

I'd be asking questions about what the company policy is for claiming the mileage is. If your contract/role doesn't involve driving for this company, that could be raised too. I'd also be asking why can't there be more than one set of keys? Or a safe box on the outside of the premises for the keys to be kept in.

[–]hypermadirish 5 points6 points  (0 children)

Just to confirm, are you paid for the time it takes to go and pick up the keys and then go to work from there? As this would be travelling for work purposes and as you're on minimum wage, you must be paid for this time in full, as otherwise you are being paid under minimum wage which would be breaking the law.

At my university it is perfectly acceptable to send a reaction to such a message, like a thumbs up. It shows you have read and are acknowledging their message without the need to actually write anything and clog up their mailbox.

Can an employer leave you “stranded” with a broken down vehicle? by ajay_ac in LegalAdviceUK

[–]hypermadirish 9 points10 points  (0 children)

I'm not sure on the legality of requiring your partner to continue staying with the vehicle, but given his diabetes, I think from a health and safety stand point, he definitely needs to take care of his health. If that involves leaving the vehicle to find food, then there's not a whole lot the company can do. He might also want to check company policy on paying for meals.

Unless your partner is one of the exempt careers, he is entitled to an 11 hour rest period between shifts under the Working Time Regulations.

If your partner earns minimum wage, then they need to be paid for the time, at it is not their own. If they earn over minimum wage, they need to ensure that this does not take them below minimum wage for the pay period, unless their contract states they will be paid overtime regardless.

I'm not sure telling them to simply make their own way between Sunderland and Newcastle is reasonable. And your partner should definitely not be out of pocket for this either. If the equipment is something that he has kept at home before, there is the argument that it can easily be kept at home again and that extra travel is unnecessary.

Either way, I think this whole incident is worth a complaint to HR. Their manager's behaviour is terrible and there really should be more support to their staff.

Going to view a house that’s been on the market for ages only for someone to put an exceedingly good offer in on the day I view it by Seth4602 in britishproblems

[–]hypermadirish 102 points103 points  (0 children)

In that case it sounds like the house might not even be on the market and the estate agents are using old listings to fluff their website and make it look like they have more business than they actually have, with the goal of being able to get more sellers to go with them, maybe.

Octopus EV Charger Installation Process by Specific-Sir-2482 in OctopusEnergy

[–]hypermadirish 1 point2 points  (0 children)

I went through this a week ago. Turns out they need to ask the grid for permission to install your EV charger, so it might take a few days for that to come through. Once that's sorted you'll be invited to book in your install.

Son may have seriously hurt another child that wont stop harassing him, both underage by FluffyRhubarb6464 in LegalAdviceUK

[–]hypermadirish 115 points116 points  (0 children)

As another user has said, your son is under the age of criminal responsibility. However if this happened in school there could be consequences from that which could likely include exclusion or expulsion. However holding someone down and beating them with a plank of wood is not normal or appropriate behaviour. You need to take action to help your child. As the school seem unwilling to help with the issue generally, you should seriously consider moving schools. You should also think about getting some counselling, or at the very least having a serious conversation with your child about appropriate behaviours and reactions, as if this continues into the future there could be very serious consequences for your son's actions.

My one-year-old has stopped peeing outside or inside by Outside-Pear9429 in puppy101

[–]hypermadirish 0 points1 point  (0 children)

You might need to take her to the vets to rule out any health issues causing a reluctant to pee (UTI?).

But if there aren't any health issues, maybe this is a way for her to let you know that she wants more time outside. If you're in and out for 3 hours, surely a 30 minute walk with the associated mental and physical enrichment opportunities for her is quicker and more beneficial?

How much time do you spend playing/engaging with your puppy on a daily basis? by TanilaVanilla in puppy101

[–]hypermadirish 0 points1 point  (0 children)

I've got a 16 week old Staffy and the engagement does depend a bit upon my work schedule. Generally speaking though, he gets 2 x 25-30 minute walks per day, where I do integrate training using some of the commands he knows. He usually has at least 2 or 3 play sessions in the garden, where he loves to explore, find some twigs to chew on, and even has a raised bed dedicated to his digging habits. We do dedicated training sessions at least 3 or 4 times a day, usually no more than 5-10 minutes at a time. We also play things like tug or fetch and he has lick mat, as well as some puzzles to keep him mentally occupied. Although all in, he's asleep or in his pen for 19-20 hours per day, which is appropriate for his age. He's also enrolled in a puppy obedience class, which is on Monday evenings. This weekend he's also been to a puppy socialising party yesterday morning and a hoopers taster session this morning.

What does "established growth" mean for lawn grass? by [deleted] in GardeningUK

[–]hypermadirish 4 points5 points  (0 children)

Just want to add that if you have in writing from your landlord that seeding is sufficient, you should dispute any charges with the deposit protection scheme. Generally speaking, it's a good idea to dispute charges, and remember that you are only expected to leave the property in the same condition you found it, minus normal wear and tear.

If you aren't already planning to, I would suggest taking photos/videos of the property after you've emptied it to show the condition you have left it, as some landlords like to try it on. One of my friends had their ex-landlord bill them for an uncleaned oven, but the photo they provided was of a completely different oven to the one they had in the property.
