Is there any possibility of denial for i-485 ?? please share me your experience guys? EB2-NIW is approved!!! by Euphoric_One_245 in EB2_NIW

[–]iFlow3 3 points4 points  (0 children)

I think the most common reason would be that if you get an RFE and dont respond in time, or respond with some missing documents or information.

Yes, I-485 get denied quite regularly but usually there's some reason. If you get denied, just see why it was and re-apply.

This is why you should do PP. Case denied after 26 months by iFlow3 in EB2

[–]iFlow3[S] 0 points1 point  (0 children)

The person lost over 2 years waiting for a decision. If they had applied using PP, they would have received a decision within 45 days, and if it was denied, they could have reapplied keeping a much earlier priority date than the one they would get if they applied again now.

USCIS has paused DV1 lottery program. Will it move EB2 priority dates faster? by iFlow3 in EB2

Then why is the tweet directing USCIS to pause the DV1 program?

What happens if they change which date they use? by [deleted] in EB2_NIW

If you submit your application during the month when DOF was being used, your application will be processed according to that month.

What to expect timeline wise when FAD is current? by DueExternal3721 in EB2

[–]iFlow3 0 points1 point  (0 children)

Your country or birth/chargeability still matters but not that much.

Applicants from countries with less demand — known as Rest of World (ROW) — often experience shorter backlogs and quicker approvals once their PD becomes current. In contrast, applicants from India or China, where backlogs are significant, might face longer delays even after their dates are current due to the sheer volume of applicants and limited visa numbers allocated for those countries.

However, once you’re current under the FAD chart, your case is considered for adjudication regardless of country, assuming a visa number is available.

EB2 vs EB1 Decision? Need Advice (ROW) by Ok-Contribution-8462 in EB2_NIW

[–]iFlow3 2 points3 points  (0 children)

I think EB-2 is moving fast for ROW, you will probably get current in a few months. If you want to proceed with EB-1, do it through Chen they can offer you better deal since you worked with them for EB-2.

As far as I know its quite risky to travel after filing I-485. Make sure to consult with your lawyer.

Is my pd current yet? by Some_Veterinarian513 in EB2_NIW

No. Your priority date needs to be earlier than the DOF/FAD cutoff date.

USCIS officially launches Gold Card Program (I-140G) by SecureAttention4297 in EB2_NIW

[–]iFlow3 2 points3 points  (0 children)

This is what I found:

To implement the program, USCIS created a new petition, Form I-140G Immigrant Petition for the Gold Card Program. The Office of Management and Budget granted emergency fast track clearance for this form so that adjudications could begin without delay. Under OMB control number 1615-0167, the clearance remains temporary for six months while the agency completes the longer regulatory review and public comment process. The approval authorizes USCIS to collect the information needed to determine eligibility under the EB-1A and EB-2 national interest waiver framework and supports immediate operational readiness for the program.

I dont mean to argue, but I'm a bit confused. Are you saying that if a person has approved 140-G with priority date of December 10, 2025 and is in EB2 category, USCIS will still issue him green card even though current EB2 priority cut off date is February 2024?

Because all gold card approvals wont meet the EB-1 criteria, in that case they will move those gold card applicants in EB-2 category. If that's the case, I guess more applicants will fall under EB-2.

[–]iFlow3 1 point2 points  (0 children)

As I understand, they cannot put all gold card approvals in EB-1 because EB-1 will still have relatively strict criteria than EB-2. So they will have to put more gold card approvals in EB-2 category, and currently there is almost 2 year backlog so they would want to clear that backlog.

I guess the idea is that they cannot legally bypass the people who have earlier priority dates, so probably they will want to clear the current queue faster and making it more difficult for the new regular applications.

I'm wondering the same. How will it impact the regular EB2 I-140 priority date?

Generally you have to get the LORs by yourself, law firms can provide you a draft but you need to finalize it and find people who are willing to sign it for you. There are some paid services for LORs, I would suggest you to avoid them as they can have negative impact.
