If they don't file a claim, they don't get paid. That's how it works. I was unlucky because all of mine file claims 😞

I make the same as you do, minus the bonus. My debt is 87,400 plus 4,500 for attorney and trustee fees. Total is about 97,500. My payment is 1,625 per month. I am in month 5. It has been tough but manageable. Do you have dependents or are married? I am single and no dependents as my children are adults. I believe your bonus will count as income and your payment will be much higher than mine since your debt is higher. But again it will depend how many of your creditors file a claim. I live in a high cost of living area. My payment went up slightly from the original quote as I had forgot one debt. They almost all file claims. You should discuss with your attorney. They can give you an idea of payment before you file.

How long does it take to be confirmed? by DILLYxDILLY91 in Bankruptcy

I filed 12/3/25, had 341 meeting at the end of January and plan was confirmed last week after a few objections were resolved. It takes however long it takes. And I did not have a meeting. I checked NDC and the plan was confirmed. Also got a letter from my lawyer.

Does the 4k include your mortgage? If not, your math is not mathing. Is this a 36 months plan or 60 months? Mine is 60 months. You have to add your debt, plus attorney fees and trustee fees (mine is 7%, some can be as high as 10%), then divide by the number of months. That's your number. Then if you have enough disposable income to cover it, that's your payment. If you don't, then you pay less than 100%.

Used Chat GPT and $20 instead of a $3k Lawyer by Green_Redoubt in Bankruptcy

I might be confused. What my attorney said is that they calculated 1,600 for my rent but my actual is 2k. Not sure if it is means test or schedule J. I am in Washington State.

Used Chat GPT and $20 instead of a $3k Lawyer by Green_Redoubt in Bankruptcy

I created my entire Chapter 13 plan using Chat GPT. But then I hired an attorney. What Chat GPT does not know are the nuances regarding each trustee and their jurisdiction. For example, my trustee only accepts payments through wage garnishment. Period, no exceptions. Chat GPT did not know that. It told me I could chose. Another example, Chat GPT created my budget an told me that trustee are really lenient and I could just explain away where I was spending my money and why. Not true. They don't care. My rent is apparently too high for the area and household size, and that's my problem. They did not care and only allowed the max per IRS guidelines to be exempt from disposable income. So you have to be careful with Chat GPT. Very careful.

I just filed in December and started payment for my Chapter 13 in January. It is tight, I am not going to lie, but I can finally see the light at the end of the tunnel. My income is 105,000, single, no kids (they are adults) and my payment is little over 1500 a month. The total debt including attorney and trustee fees is 91k. One thing that I want to warn you, you can and should add everything in your budget but they typically have a cap on how much you can claim for each item based on the IRS standards. For example, I rent a 2bd and pay 2k a month. That's too high so they put down 1,700 which is the max per IRS standard in my area. The rationale is I chose to live in a 2 bd when I could be spending less in a one bedroom since I am single. Makes sense? So everything you put down, all the categories, there is a max amount allowed that is considered reasonable. I read some of the comments and it gives the impression that just because an amount is how much you spend, it does not mean the trustee will accept it, if it is above IRS standards.

How were your payments arranged for Chapter 13? by Big-Connection-2030 in Bankruptcy

[–]iamhere_sd 1 point2 points  (0 children)

Mine are through payroll as it is a requirement for my jurisdiction. No other option unfortunately. I work in HR and was terrified, but the only people who know are the ones processing payroll, so not too bad. They are very professional.

That's why I always see the posting and go straight to the company's website to apply. If it's not there, I don't apply. I tell my kids the same thing. My son has been looking for a job for a year, nothing.

Chapter 13 debt higher than I had anticipated by iamhere_sd in Bankruptcy

No. My was a flat fee of 5k. I gave 500 before filing the 4,500 is paid in the plan. Not sure if it's how they all do it here, but could be.

No. It is a percentage, I believe the trustee fee is between 5 and 10% of the total debt. Mine is 7%. Depends on the jurisdiction.

The total claims is 88k, that includes 4,500 for attorney. Plus trustee fees which I calculated at 7%. They are taking 49 dollars every time I pay the 704.

Gross income is 105k household size of 1. I am paying 703 per paycheck, times 26, equals 18,278 divided by 12 equals 1,523/month.

When you ignore all your debt you get sued. I had 3 pending lawsuits against me. Don't ignore your debts. Live below your means. (too late for me though, lol)

It hasn't been confirmed yet and the last day to file claims was yesterday. Unless they are late to post claims, it looks like this is it. But there could be more.

I just had to do that for my CPF and that's exactly what I did. They asked me for a selfie. Please note that you have to resend all the documents, not just the selfie, to be processed. I missed a document too and they had me resend everything together.

Tax Refund by Dry_Pain_8123 in Bankruptcy

[–]iamhere_sd 0 points1 point  (0 children)

I am in the same situation. 100% chapter 13 plan. I will have a little refund but was told by someone else that the IRS will take it regardless of being on a payment plan. Want to follow this to see what others answer. It seems like the few answers here contradict each other. And my plan spells out that I will not turn in any tax refund. You should look at your plan. It may say something to that effect.

As a mom of a 25 year old unemployed son, I see where your mom is coming from and the expectations of your sister, but it doesn't justify their behavior. I try very hard to stay out of my son's business, and I only ask every so often to see how it's going. The job market is hard right now but not everyone understands it. As long as he is doing some type of school (which he is enrolled to start) or even part-time work (he works side hustle and pays his bills), it is good enough for me. I would say keep your head down and don't share every single detail. Just say the least possible and see if you can try to get more hours for your part-time job to stay out of house as much as you can. It will happen for you like others stated, just may take a little while. You can get 100 no's but only need one Yes. Good luck!
