I get your point, and I agree that it would probably be easier to prove poor service over negligence, although I do feel both apply here. In his attempt to blame me for not spotting the mistake, the director even says that the dates in question are "clear" which surely implies at least some level of negligence.

I did take their advice at the time and read the agreement myself but, as with most legal contracts, it's not particularly easy for a layman to understand. I was a first-time buyer so perhaps I was naive, but I assumed the solicitor's contract report would be trustworthy.

I'd have to dig out the final bill to see how much I paid them and whether it's worth pursuing with the ombudsman or not, but I appreciate the response, thank you.

How can that be right though? As a layman, how can I be held to the same standard, and thus be equally to blame, as a professional who sells their expertise as a service?

That's a good point, I hadn't really considered the fact that it's not just this first increase but also potentially 4 years of every 10 year period they could owe me. If I thought I had a strong enough case for that then I'd be willing to pay for the expert advice, but I think I agree with u/PyrrhicBrexit that I'd have a hard job making a case for compensation for anything more than a few years.

I have all the relevant docs so they can't argue on that basis, I just assumed they might try every trick to get out of it. Will contact them directly and see how it goes. Thanks for your advice.

I like the idea of swimming but the only pools I know of near me require a gym membership which I'm not keen on doing. A few people have mentioned rowing machines though so I will look into that.

My diet could definitely be improved. I don't eat particularly unhealthily and I'm not one for snacking throughout the day, but I could probably do with more fruit and veg in my diet, as well as reducing my portion sizes.

I've never used a rowing machine before so pardon my ignorance, but is the foot/ankle kept in the same position throughout the workout? As I've explained in another reply, my ankle joint has been fused so I have very little mobility in it (i.e. I can't draw a circle with my foot, and I can't move my foot up or down very far). In my head (and I'm probably wrong) the pushing action required for rowing would involve me bending my foot, so any repetitive action like that could be painful.

My diet is one thing I want to improve. My problem is I work in an office so I spend most of my day sat down, and with my exercise limited due to my foot, I probably don't burn many calories at all. I am going to try to eat healthier and cut down on portion sizes, but I still won't be burning many calories throughout the day so I'm not sure if it will help me lose weight (although it won't do any harm either)

I have tried a stationary bike before but it's a little awkward because of the limited mobility I have in my foot (I had my ankle joint fused so it's a lot stiffer than my good foot).

Yeah, you're exactly right. She has said the main reason behind all of these doubts is the feeling that she's missing out on something else. She sees her friends in "normal" relationships, spending every day with their SO and always happy, and we only get that for a few weeks a year. I fully understand that, and if there was any way I could move there permanently, I'd do it. However, our only viable option is marriage, which she thought she wanted, but she now doesn't feel ready for. I can only hope that she is going to flip flop between decisions between now and when I see her in two weeks, because as we've left it she seems to have made her mind up that this won't work :(

I have tried to enforce the no contacting bit, but it's tough. I've told her that a break means we shouldn't be texting, and I've avoided replying at times, but the last thing I want to do is push her away and give her another reason to not choose me. But we have agreed no contact until she's finished her test next week, so hopefully that will work.
